submittal time -frame (by the applicant to the City) mandated by the City. The 90
day turnaround period begins on the date of this comment letter (December 28,
2000) prepared by the project planner in the Current Planning Department. In this
case, revisions must be submitted no later than March 28, 2001 by 5:00 p.m. Upon
receipt, the revisions will be routed to the appropriate City departments and outside
reviewing agencies, with their comments due to the project planner no later than the
third weekly staff review meeting (Wednesday mornings) following receipt of the
revisions. At this staff review meeting the item will be discussed and it will be
determined if the project is ready to go to the Planning and Zoning Board for a decision.
If so, will be scheduled for the nearest Board hearing date with an opening on the
agenda.
Please return all drawings red -lined by City staff with submission of your
revisions. Also, the number of copies of revisions for each document to be
resubmitted is on the attached Revisions Routing Sheet (both sides).
You may be aware that Ron Fuchs recently left the City of Fort Collins to accept a
planning position in Minnesota. I will be assuming the role of project planner for this

15. Dennis Greenwalt of AT&T Broadband (cable television) stated that they have
no concerns or comments regarding this development proposal.
16. Mike Spurgin of the Post Office stated that they have no concerns or comments
regarding this development proposal.
17. Dean Smith of the Boxelder Sanitation District stated that they have no
concerns or comments regarding this development proposal.
18. Gary Huett of Public Service stated that the final subdivision plat of this
development needs to dedicate 9' minimum width utility easements adjoining the
right-of-way (ROW) lines on both sides of all internal streets. 15' minimum width
utility easements will be required on the north side of County Road 52 and the
east side of County Road 11. More specific comments are reserved for the final
platting.
19. A copy of the letter received from Mayo Sommermeyer of The Dow Law Firm,
LLC, the attorneys for the Windsor Reservoir & Canal Company — No. 8
Outlet Canal, is attached to this comment letter.
20. Rick Richter of the Engineering Pavement Department stated that they have
no concerns or comments regarding this development proposal.
21. Webb Jones of the East Larimer County (ELCO) Water District stated that his
comments are on a red -lined Master Utility Plan for the LIND Property.
22. A copy of the comments received from Peter Wray of the Advance Planning
Department is attached to this comment letter. Please contact Peter, at 221-

23. Karen McWilliams, a Historic Preservation Planner with the Advance
Planning Department, stated that any buildings or structures on the property 50
years or older will need to be reviewed for their significance under the City's
Demolition/Alteration review process. Please contact Karen, at 224-6078, for
information regarding this process.
This completes the staff comments at this time. Additional comments will be
forthcoming as they are received from City departments and outside reviewing
agencies.

10. Beth Sowder of the Streets Department stated that they have no concerns or
comments regarding this development proposal.
11. Craig Foreman of the Parks Planning Department stated that their
neighborhood parkland figures indicate a need for a 4 to 6 acre public park on
this property. They would not want the park acres as shown at the intersection of
County Road 11 and Richard's Lake Road (County Road 52). It would be better
to work on an acreage where the park and trail are shown near the No. 8 Outlet
Canal.
12. Doug Moore of the Natural Resources Department offered the following
comments:
a. A study of the existing hydrology/water quality/groundwater for the No. 8
Outlet Canal is needed. (This is a prior comment made at conceptual
review on August 21, 2000).
b. A wetland delineation is needed for the No. 8 Outlet Canal.

14. Rick Lee of the Building Department offered the following comments:
a. Please find attached the various codes that the Fort Collins Building
Department will enforce.
b. The information submitted suggests that multi -family housing or "high
density" housing will be provided. They want to inform the applicant that
they are currently enforcing the 1998 ANSI for accessibility and a State
statute, which requires that on common property one accessible (Type 'A')
unit for each 7 units, or fraction thereof, shall be provided. Accessibility is
required in most R-1 construction, so pay careful attention to the
requirements of ANSI and what items are required in a Type'A' dwelling
unit.
C. As more information becomes available code -specific issues will be
addressed.

3. Ward Stanford of Traffic Operations offered the following comments:
a. Their comments regarding the ODP do not reflect in-depth traffic review
for project impacts, only generalized land use -based traffic comments. In-
depth comments on the TIS and the project will come with the Project
Development Plan (PDP) review.
b. The TIS needs to take into account the traffic from Hearthfire, Richard's
Lake - Phase 1, Storybook, Gillespie Farms, and any other currently
proposed projects in the area.
C. The TIS must give an analysis for both the Country Club Road & County
Road 11 and the Country Club Road & North Lemay Avenue
intersections.
d. This project should have connectivity with the land across the ditch.
e. The current street layout does not assist in encouraging motorists to drive
through the development in a safe and lawful manner. Traffic Operations
suggests street planning that will reduce roadways that encourage
speeding and cut-thru traffic.

6. GayLene Rossiter of Transfort stated that currently no service exists and no
service is planned with the City's Structure Plan (2020 Transit Plan).
7. Jennifer Nuckols of the Zoning Department stated that they have no concerns
or comments regarding this development proposal.
8. Monica Moore of the Light & Power Department stated that they have no
concerns or comments regarding this development proposal.

Staff has reviewed your documentation for the LIND Property, Overall Development
Plan (ODP) — Type II Review under the Land Use Code (LUC) that was submitted to
the City on September 11, 2000, and would like to offer the following comments:
1. The LIND Property, ODP was first submitted to the City on September 11, 2000
to meet an imposed State-wide deadline associated with the Amendment 24,
Growth Initiative placed on the November 7, 2000 election ballot. This request
was not routed through the City of Fort Collins development review process until
November 15, 2000.
2. Tom Reiff of the Transportation Planning Department offered the following
comments:
a. There is a concern about the adequacy of the proposed 2 points of
access from County Road 11 into the proposed residential in Tract A.
b. Show conceptual alignment and exit points of the proposed internal trail
along the canal, so other potential developers can connect to the system.
C. Are pedestrian access points to the regional trail system on the southwest
corner of the development at grade or separated? Please identify.
d. There is a need to arrange a development charrette with the developer
and adjacent developers to determine proposed roadway classifications
and actual alignments of the proposed road network (internal and
external).
