Re: Lincoln Project —Transportation Fee
Thank you for convening a meeting Wednesday to consider, in my view, the unique
circumstances surrounding our Lincoln project and the inequity of imposing the new (January 1,
2006) fees on this project.
I have asked North Star Engineering to prepare a timetable from October 11th, 2005 on with
regard to the various matters relating to the complexities of the stormwater problems with this
project, how they are inextricably linked to the regional stormwater problems and solutions, the
evolution of technical studies and designs related to the regional stormwater problems and
potential solutions, political considerations regarding the foregoing, and the necessary
reconciliation of City and County views on all related matters.
I understand that after confirming the facts of this matter with Jim Hibbard, you will be asking the
City Manager and the City Attorney about possibly reducing the transportation review fees for
this project to those actually incurred to finish this project (as it Is very close to completion).
I respectfully request that you also ask about possibly waiving the fee in its entirety because (a)
our delays past January 11, 2006, were caused by the City and County's delays and problems,
with regard to both regional storm drainage technical matters and political considerations, and
(b) that in agreeing to resubmit we relied, to our detriment, on the implicit representation that
total fees on the re -submittal would be $3000. We understand that any further consideration of
this matter will be by City Council.
