consideration of Ten Dollars ($10.00) in hand paid, receipt ofwhich is hereby acknowledged, and

Collins, Colorado, a Municipal Corporation, for public use forever a permanent easement for

Re: Lincoln Park Project /
Letter of Intent to Grant a Sight Distance Easement
TO WHOM IT MAY CONCERN:
This correspondence will confirm that, upon approval of the
Lincoln Park Project, Bank of Colorado (the "Bank") intends to
grant a perpetual sight distance easement, in form substantially
similar to Exhibit "A" attached hereto and incorporated herein
by this reference, to either the City or Lagunitas Lincoln, Inc.
("Lagunitas") (as may be required by the City) over the
northwesterly portion of Parcel No. 87072-43-001, Lot 1, Bank of
Colorado Subdivision, City of Fort Collins, County of Larimer,
State of Colorado, as shown on the plan attached hereto as
Exhibit "B" and incorporated herein by this reference. The
Bank's intent to grant such easement is expressly contingent and
conditioned upon Lagunitas obtaining City approval of design,
engineering and development plans for Lincoln Park Project,
including access to the Bank's parcel, through Lincoln Park, to.
the Santiago -Lincoln intersection, as shown on the plan attached
hereto as Exhibit "C" and incorporated herein bythis reference
(or as otherwise agreed to or at such other location and
configuration as may be approved by the Bank), at no cost or
expense to the Bank, and satisfaction of the conditions set
forth in the Letter Agreement between the Bank and Lagunitas
concerning such an easement.

Lincoln Hearing.

Cameron, if you would be so kind as to schedule the Lincoln hearing, I would very much
appreciate it.
All of the conditions to the hearing, which were set the last staff review meeting, have been
substantially met.
With regard to one, as we discussed, the line of sight easement, enclosed please find the line of
sight easement which the bank has proposed and which is satisfactory. This line of sight
easement will be part of the approved Lincoln Project in any and every case. As I also
mentioned, while we have some details to be worked out in the agreement between the bank and
ourselves by our lawyers, which will take some time, we really need to get this project to hearing
immediately because we have no more extensions.
If you could set the hearing, I would be most appreciative.
Also, FYI: Understandably, after all these years, we have the Webster family breathing down
our neck to get this project wrapped up and approved.
