We are in receipt of your letter dated' March 20, 1998 in regard to the above referenced project.
This letter is intended -to provide documentation of recent project. activity, and justification to
continue the submittal: and review process relative to this P.U':D:
Following our submittal on. October 31,. 1997, an agreement, was, formed,between, Summers,.
Diamond Shamrock; and W.O. Brisben Co. (Buffalo Run), to provide preliminary roadway design
for N. Lemay Avenue and Lincoln Avenue. This work was initiated' by Sear-Brown/RBD in mid -
January 1998 and was submitted and. subsequently reviewed by transportation in a meeting
with Sear-Brown/RBD on -March 25,1998.
On November 19; 1997 we received notification that Diamond Shamrock had canceled'their
purchase contract on Lot 1 and would make no further planning applications to the City of Fort
Collins relative: -to Ahis -location.: .They did, however,:, -honor .:their -previous agreement to
participate in the preliminary roadway design work.'
In the past few weeks we have been informed that Schrader Oil has initiated a purchase
contract. for Lot 1. and authorized Wickham Gustafson Architects of Fort Collins to prepare a
Final P.U.D. submittal under the LDGS guidelines. Don Shields of Wickham Gustafson
indicated to me on March 31,1998 that this apprication would be completed within a 45 to 60
day time: frame. He further indicated that minor adjustment to building envelopes and other
features would be necessary but that the final• P.U.D. application would substantially comply
with the approved preliminary R.U.D:
In regard to the Quick-L' ube proposal' on Lot. 2, we did not respond to our initial staff. review
comments of December 1.0, 1997 and resubmit for final P.U'.D.. application because we were
informed we could not receive final approval for Lot 2` without a. corresponding or simultaneous
final approval on Lot 1. This was due primarily to design, of access and utility services within the
P.U.D.
