24. Utility Plans and Development Agreement must be signed off by all the affected
parties prior to obtaining a building permit. For further information regarding the
content of a Utility Plan submittal, Development Agreement, or other engineering

25. The O.D.P. should indicate future street connections to the east. This could be
at Duff, Webster, and/or Poudre Parkway. The intention is to provide an access
to the adjacent Fort Collins Business Center to the Lemay Bypass.
26. As you are aware, the City has recently adopted new standards and guidelines
for commercial development. The intent is to bring commercial development up
closer to the street edge so bikes and pedestrians do not have to cross drive
aisles and parking lots to reach the front door. Obviously, a c-store with gas
pumps presents a challenge. Staff recommends that the way to comply with the
spirit of the new standards is to provide a west -facing entry on the c-store to
establish a clear relationship to the Lemay frontage. A raised, scored -concrete
crosswalk across the drive aisle should link the store entry to the sidewalk that
connects out to Lemay. Further, this west -facing entry should feature an inviting
porch, portico, covering, benches, bike rack, lighting, and other design elements
that clearly indicate a linkage to the sidewalk along Lemay.
27. A neighborhood meeting will be required. Staff will prepare the notification area
since the 500 foot radius may not be effective.
14. According to the maps, portions of the site are located in the floodplains of both
Dry Creek and the Poudre River. Please contact Mike Grimm, Stormwater Utility
Floodplain Administrator, 221-6589 for accurate verification. It may be
necessary to obtain a Floodplain Use Permit and raise the buildings at least 18
inches above the base flood elevation.
15. Onsite stormwater detention will be required. Please note that there are
restrictions downstream which means that the site will be allowed to release
storm flows only at the two-year historic rate.
16. The quality of the stormwater that is released should be treated by the best
management practice as per the standards of the Urban 'Drainage and Flood
Control District in metro Denver. For further information on treatment
techniques, please contact Kevin McBride, 221-6589.
17. As the property owners are aware, the San Cristo P.U.D., located to the north,
needs a drainage easement across this property. The property is obligated to
accept the historic runoff from adjacent properties. A drainage easement could
be located in the 30 foot wide sanitary sewer easement and provide an outfall for
San Cristo. Please contact Jim Klein, Fort Collins Housing Authority, 221-5484,
for further information.
18. It is recommended that the developer's consulting engineer meet with Glen
Schlueter, Stormwater Utility Engineer, 221-6589, prior to designing the drainage
and grading plan.
19. At this time, Lincoln and Lemay are both classified as arterial streets needing 50
feet of half width for right-of-way. A 15 foot wide utility easement is needed
adjacent to this right-of-way. With the existing telephone easement, a utility
coordination meeting may be necessary so that all utilities may be
accommodated.
20. For the Lemay Bypass, any right-of-way that is needed that goes beyond the
normal dedication requirements for land development will be purchased by the
City as part of the capital improvement project. For further information regarding

21. A traffic impact analysis will be required. This study shall determine the need for
any auxiliary turn lanes. Please note that a curb cut on Lemay has been
approved for a use -by -right development on Lot 4 across the street on the west
side of Lemay. Plans for Lot 4 development are available from the Engineering.
and Zoning Departments.

5. The installation of underground fuel tanks will require the submittal of a
Hazardous Material Impact Analysis to be reviewed by the Fire Prevention
Bureau of the Poudre Fire Authority. The installation contractor must obtain a
separate permit from P.F.A. Please contact Ron Gonzales, 221-6570, for further
information.
6. Both the convenience store and the drive -through restaurant will require
separate permits from the Larimer County Health Department. Please contact
Jim Devore, 498-6775, for further information.
7. All buildings and parking lots must be handicap accessible as per the locally
adopted amendments to the Uniform Building Code. This requires a handicap
accessible route from the building exits out to the public sidewalks. For further

8. The City's Water Utility has a 24 inch diameter water line in Lemay on the west
side of the right-of-way. A repay is due from the developer to the City on this
water line. Please contact Brian Hahn, 221-6681, for an estimate of this repay.
The City's existing sanitary sewer line is installed as shown on the plan. At the
time of platting, this sewer line shall be placed within a 30 foot wide easement.

9. At the time of submittal for an O.D.P., an overall utility plan should also be
provided.
10. The Diamond Shamrock development will require separate water and sewer
services for the c-store and carwash. The carwash will require a sand and oil
trap.
11. Both the Diamond Shamrock c-store and the drive -through restaurant will require.
grease traps. For further information regarding water and sewer issues, please

12. The Department of Natural Resources supports the efforts to save as many of
the existing trees as possible. Protecting the root zones during construction is
imperative. The landscape plan, therefore, must include detailed tree
preservation notes. Also, it appears that there is a low area along East Lincoln
that features cattails. The developer is encouraged to incorporate these cattails
into the drainage and grading plan.
13. The site is divided into two drainage basins. First is the Dry Creek Basin with
fees of $5,000 per acre subject to the amount of stormwater detention and the
runoff coefficient. Second is the Poudre River Basin which presently has no
fees. Fees will be assessed in accordance with the natural drainage of the site
and into which basin accepts the developed storm flows.

LAND USE DATA:
Request for an O.D.P. on approximately 14 acres located at the northeast corner of
East Lincoln Avenue and North Lemay Avenue. Anticipated land uses include business
services, auto related, and industrial. Request for Preliminary P.U.D. for a convenience
store, gas pumps, canopy, one -bay carwash on 1.4 acres on the immediate corner (Lot
1) and drive -through restaurant (Lot 2).
COMMENTS:
1. Light and Power has an existing conduit on East Lincoln that can serve both Lots
1 and 2. A single transformer should serve both lots. Existing overhead lines
would have to be removed at developer's expense.
2. Transformer must not be placed adjacent to either street but shall be located
internally to the site. The transformer must be screened from public view.
Screening may be by either a solid enclosure meeting the clearance
specifications of. Light and Power or by landscape materials. The location must
be within 10 feet of hard surface for emergency change -out by a boom truck.
3. Light and Power may install new streetlights. If so, street trees must be kept 40
feet away and ornamental trees must be kept 15 feet away from streetlights.
The final landscape plan must include the location of any new streetlights so
there are no conflicts. For further information regarding electrical issues, please

4. The site is located in the Residential Neighborhood Sign District. Signage
allowances are more restrictive in this district. For further information on signage

Team on April 8, 1996.
