Mr Gloss:
This letter is a formal request for interpretation regarding the Horsetooth
Business Park, Filing Two.
I am asking that you find that portion of this property located at the
southwest corner of Horsetooth and Timberline Roads meets the definition
of "convenience shopping center". This designation would allow me to
build my new flooring/warehouse showroom facility at this location.
I respectfully request that you render your interpretation as soon as possible.

The following question has been posed for interpretation:
Is the Horsetooth Business Park, Filing Two considered a Convenience
Shopping Center?
INTERPRETATION:
Those portions of Horsetooth Office Park, Filing Two depicted on the attached
map satisfy all of the following land use, size and location restrictions found in
LUC Sections 4.22(D)(2) and 5.1.2; therefore, the area is considered a
Convenience shopping center.
• The subject area is located within the E District;
• Existing and future secondary uses, all located on contiguous parcels and
connected by master planned cross -access, comprise 6.88 acres which is
less than the Convenience shopping center limit of seven (7) acres;
• With the Horsetooth Business Park development plan a total of 32.4 acres,
the site area (6.88 acres) attributed to the Convenience shopping center is
less than the maximum of 25% secondary uses permitted within the E District;
All of the existing uses within the Convenience shopping center, including the
(former) Rite Aid building, convenience store, and car wash, and the
proposed retail store, are listed as principal uses under the definition of
Convenience shopping center;
• More than four (4) business establishments, with separate entrances, are
located within the Convenience shopping center;

SUBJECT: Administrative Interpretation #3-03 regarding the Convenience
Shopping Center definition found in Section 5.1.2 of the Land Use
Code,. and application of Section 4.22 to the Horsetooth Business
Park, Filing Two located at the southwest corner of Horsetooth and
Timberline Roads.
BACKGROUND:
Section 4.22 (13)(3)(c) of the Land Use Code (LUC) lists Convenience shopping
centers as a permitted use in the E District, subject to review by the Planning and
Zoning Board. Convenience shopping centers are also considered secondary
uses in the E District and may occupy no more than twenty five percent of the
total gross area of the development plan pursuant to Section 4.22(D)(2). Under
the Definitions listed under Section 5.1.2. of the LUC, a "Convenience shopping
center is defined as:
°...a shopping and service center situated on seven (7) or fewer acres with four
(4) or more business establishments with separate exterior entrances, located in
a complex which is planned, developed and managed as a single unit, and.
located within and intended to primarily serve the consumer demands of adjacent
employment areas. The principal uses permitted include retail stores; business.
services, convenience retail stores with fuel sales, personal business and service
shops; standard or fast food restaurants (without drive -up windows); vehicle
minor repair, servicing and maintenance uses; liquor sales (for on- or off -premise
consumption); beauty or barber shops; dry-cleaning outlets; equipment rental
(not including outdoor storage); limited indoor recreational uses; pet shops; and
uses of similar character..."
A request has been received to interpret how the LUC standards related to
Convenience shopping centers apply to the Horsetooth Business Park.
