auto related commercial development will assist the City's Director
of Engineering in determining how much "offsite" improvement will
be necessary in order to integrate the P.U.D. with the future Lemay
Avenue Bypass project.
Please be aware that the other offsite work may include such soft
costs as surveying the proposed right -of -dedication, preparing the
appropriate legal documents, and preparing the deeds of dedication.
Nic, as you are aware, development of the entire Webster property
represents a complex project with many variables. Not the least of
which is an Overall Development Plan for the entire 17 acres
including establishing a logical internal street system which ties
into the adjoining vacant property and industrial park. Other
variables include the timing of the Lemay Bypass project. Finally,
the potential right-of-way dedication - street improvement trade is
subject to approval by City Council.

RE: Webster Property at Lemay Avenue and Lincoln Avenue
Dear Mr. Chenoweth:
The purpose of this letter is to clarify the extent of work that
may be required in developing the Webster property at Lemay and
Lincoln. At this time, the potential development of this parcel
includes an auto related commercial center on approximatley three
acres anchored by a convenience store with gas sales and carwash
facilities. Such development would be processed as a Planned Unit
Development (P.U.D.). This three acre parcel has frontage on both
Lemay and Lincoln, classified as arterial streets.
As we have discussed, the Lemay Avenue Bypass must be accounted for
in the design of the P.U.D. We have also discussed the potential
for trading the owner/developer's obligation for construction of
the "local street portion" of the Lemay Bypass in exchange for the
right-of-way needed for the road alignment. Such trade would be
based on an evaluation of land costs and the estimate of
constructing the "local street portion" of the arterial. If the
appraised value of the land for right-of-way and the cost of the
"local" street improvements are found to be comparable, the City
may elect to enter into a trade.
In a related matter, the development of the three acre P.U.D. will
require that a certain amount of "offsite" design work be done in
order to determine that the public improvements associated with the
P.U.D. (streets, turn lanes, sidewalk, curb, gutter, underground
electric, storm sewers, etc.) will be properly integrated with the
Lemay Bypass project. This integration will require close
coordination with the City Engineering Department.
The developers of the P.U.D. should be aware that public
improvements to arterial streets:
shall be constructed to such specifications as shall be
necessary in the judgement of the Director of Engineering
based upon traffic safety considerations, and taking into
account the traffic impact of the development upon such
arterial or collector street." (Section 29-679 {a} (31 of the
Zoning Code.)
