for the Horsetooth East Business Park, Filing Two, Pad 'D' —

Dear Ms. Doorman,
The applicant, representing Timberline Partners, Limited LLLP and GB Ventures, LLP,
submitted a request on July 27, 1999 for a Modification of Section 4.22(D) Land Use
Standards in the Employment Zoning District of the Land Use Code (LUC), more
specifically Subsection 4.22(D)(2) Secondary Uses. The reason for the request was
because the proposed restaurant use, defined as a "secondary use" in the E District,
can be no more than 25% of the total gross area of the development plan (site). Section
4.22(D) Land Use Standards, Subsection 4.22(D)(2) Secondary Uses states:
"The following permitted uses shall be considered secondary uses in the E zone
district and together shall occupy no more than twenty-five (25) percent of the
total gross area of the development plan."
Standard restaurants are listed as a permitted use in the aforementioned subsection of
the LUC.
The Planning and Zoning Board, on December 2, 1999, approved the request for a
Modification of Standard in Subsection 4.22(D)(2) of the LUC for the Horsetooth East
Business Park, Filing Two, Pad `D'. This approval is only for the property
owner/developer's right to submit a formal Project Development Plan proposal
containing a restaurant use to the City of Fort Collins for review. The Project
Development Plan proposal will be evaluated against, and must meet, all applicable
criteria in the LUC; and, it must be approved before the development plans could be
recorded and filed, enabling the developer to be issued a building permit.
