College Avenue Fort Collins, CO 80524 Dear Tim: This is regarding the proposed Sandcreek Estates Minor Subdivision, which is adjacent to the Larimer and Weld Canal. Mr. and Mrs. Kniege were deeded the land, which encompasses the south half of the canal and the access road along the canal. The owners want to deed the right-of-way to the Irrigation Company either by a quit claim deed or other means you would suggest. The proposed lots are not a part of this right-of-way. I was surprised that the Irrigation Company was opposed to the proposed subdivision. The subdivision is below the canal and is not draining into the canal. The owners will deed the right-of-way and will indemnify the Irrigation Company for seepage and will place a note on the plat stating as such. Your other notes suggested in your letter can be placed on the plat. It seems all of the above issues are being favorably addressed by the owners. The City of Fort Collins will require the Irrigation Company to sign off on the Minor Subdivision Plat and the utility plans. If you have any questions concerning this project, please call.
