The top of berm elevation for that facility would be at 4976' elevation. The dedicated Right of Wa currently shown on the plans will not allow for the pond to be contained off -site. Please either increase the Right Of Way to width of 160 feet or some fill would be needed on your site to bring it up to a 4976 elevation. The ditch company has indicated that it is opposed to this development. The city requires ditch company signatures on the Utility plans for all property bordering irrigation ditches. Please be advised that you will need to work directly with the ditch company to obtain approval. Any grading within the ditch easement will also require grading easement. Please tie in all existing off -site contours to the proposed contours. Most existing contours are very hard to see on the current plans. WYOMING 82001 ALSO ADMITTED IN WYOMING ALSO ADMITTED IN ARKANSAS 8 TEXAS Please be advised that this firm represents Larimer and Weld Irrigation Company, which owns and operates the Larimer and Weld Canal. We have reviewed the proposed plat for Sandcreek Estates with our client and have the following comments and concerns about this proposed development: 1. There are potential seepage problems from the Larimer and Weld Canal in this area. The proposed subdivision lies immediately south and down -gradient from the ditch. There are seepage problems, especially concerning lots 1, 21 31 5 and 6. A note to this effect should be included on the site plan and the subdivision plat. It may be necessary for the developer to take special caution in developing these lots and in the construction of any homes along these lots, including the possible requirement for installation of perimeter drains or other such steps to address the ditch seepage issue. 2. A note should be included on the subdivision plat and the site plan prohibiting any development within the ditch company's easement and limiting access of any potential lot owners to the ditch. 3. The board of directors of the ditch company does not believe this area is necessarily suitable for the development proposed and therefor opposes the project.
