I reside in a legal duplex at 123-125 N. Loomis Avenue in the city of Fort
Collins and am intending to construct an addition to my home. I am requesting an
approval of a "Change of a Non -Conforming Use and Enlargement of a Building
containing a Non -Conforming Use" with the Planning and Zoning Board of the City.
In accordance with the Non -Conforming Use Review, which is structured
more toward commercial projects, I am asked to obtain a drainage report prepared by a
licensed professional engineer in addition to an erosion control plan with a minimum
deposit of $1,000. This review is more comparable to a residential addition in which an
erosion control plan is not required I am requesting a variance from these requirements
based on compliance with the fact that the impervious surface area of the structure with
the proposed addition is 19.7%, well within the 40% specification of the Old Town
Drainage Basin Master Plan. This proposed residential 1 story addition is a modest
structure containing 576 square feet attached to the rear of the house in the backyard.
