Oe 5. The Mapping Department has noted that the legal description
PV_,y does not match the map, and the map does not close. The Plat
IN111 needs three control corners, each described. Outer -boundary
monuments must also be described. The width of the sewer
easement crossing the canal north of Lot 4 must be shown.
CIt is unclear whether the Larimer and Weld Canal Company has
a traditional prescriptive easement for their canal or if the
canal is a separate legally defined tract of land. The
language for any easement has not been provided in the legal
description on the plat or in any separate documents submitted
' to the City and must be clarified. As either an affected
property owner or a affected party -in -interest, the Larimer
and Weld Canal Company will be required to "sign off" on the
Plat and Utility Plans. Please provide the appropriate
signature blocks. In addition, Please refer to the attached
U, ,.1 VV letter dated December 16, 1994 from Timothy Dow whose law firm
represents the Larimer and Weld Canal Company for their
i concerns and comments. A public hearing can not be held and
�� potential approval gained if the ditch company refuses to
LcN "sign -off" on the proposed development. Please contact Mr.
Dow at 482-4011 to discuss options.
7. The Engineering Department's comments on the Plat and Utility
plans have been forwarded to Stewart and Associates as of the
date of this letter.
8. Attached is a copv of the comments from the Stormwater Utility
Department.
This completes the review comments at this time. Additional
comments may be forthcoming as the various departments and
reviewing agencies continue to review this request.
A public hearing on the Sandcreek Estates Minor Subdivision will
not be scheduled with the Director of Planning until all comments
have been addressed by the applicant and revisions have been
submitted and reviewed. Referral to the Planning and Zoning Board
is still a n Orticn if n_cd_°d.

Dear Russ,
Staff has reviewed your documents for the Sandcreek Estates Minor
Subdivision, that were submitted November 28, 1994, and would like
to offer the following comments:
The City Fire Code requires that no exterior wall of any
n residential structure be greater than 150 feet from the street
pf 1 unless an approved residential sprinkler system is provided.
���, It appears that Lots 1, 5, and 6 will most likely be impacted
vt" "�� i by this requirement.
r The Parks Department will provide a fence around the weir
located at the northern portion of the irrigation easement on
Lot 6.
O�,j3. The Light and Power Department notes that if rock is
0-1W1 encountered (as expected) during the installation of light and
power facilities, additional costs will be at the developers
expense, in addition to normal electric development charges.
Portions of this property serve as a corridor for wildlife.
1 As provided in Section 29-656(d) of the City Code,
"OutStand iny natural aiiu cultural features such as 5t:en is
spots, watercourses and historic sites and buildings shall be
preserved insofar as possible". To maintain the functional
characteristics of the corridor, a landscape buffer must be
provided on the northern property lines of Lots 1, 3, 4, 5,
and 6 adjacent to but not encroaching any portion of the 20'
ditch access easement. As provided in Section 29-644 of the
Code, "the Planning Director may require the submission
of..... such other plans and documents as are necessary for a
full and proper review of the application". A landscape plan
must be provided which shows the landscape buffer and the
` ''I� proposed preservation or removal of existing vegetation. The
City notes that the developer is to preserve existing
vegetation on the property as previously discussed in the
field.
