HomeMy WebLinkAboutGLENMOOR P.U.D., 2ND & 3RD FILING - PRELIMINARY / FINAL - 8-95C - CORRESPONDENCE - VARIANCE REQUESTInteroffice Memorandum Date: August 2, 2000 To: Can McNair, City Engineer Thru: Dave Stringer, Development Review Manager From: Tim Blandford, Project EngineerT RE: Variance Request for'GlenmoorPUD, 2nd and 3rd Filings Stewart a Associates, on behalf of the Developer for the Glenmoor PUD, 2nd and 3rd Filing project, has submitted a variance request to the City of Fort Collins design standards. This variance request is for a proposed headwall and wingwall for Plum Creek at South Taft Hill Road be located outside of the City's right-of-way ("ROW"). Typically, the City requires structures of this nature to be located outside of the ROW because of maintenance concerns and potential utility conflicts. A number of lots were eliminated and Kirra Court was shifted to the east to accommodate the requirements of the Sotrmwater Department. While meeting the stormwater requirements, part of the ROW is impacted. The engineer, however, believes this variance can be supported because of the accommodations made to meet the Stormwater Department's design standards. Normally 1 would not support a variance for economical reasons. However, there is a "twist" that I need to mention. The Stonnwater Department is in the process of purchasing the land for a regional detention pond and has appropriated money for the 2001 budget to do just that. The Developer, on the other hand, wishes to get final approval for his project prior to selling the land. By proceeding in this fashion, the Developer is guaranteed to get the highest value for the land. Regardless, in the end, the City will own the land and this residential development will not happen. I have confirmed this with Glen Schleuter and have attached a letter addressing this situation. With that, it is my opinion that this variance can be supported based on the fact that the single-family housing project will never be constructed. The Stormwater Department will buy the land and turn it into a regional detention pond. If the headwall and wingwall is still needed and incorporated into the design of the detention pond, the Stormwater Department will take over the maintenance.
