engineering fees it pays or incurs to review these computations and
the proposal as to engineering matters.

RE: Waterfield P.U.D.; F-irst Filing; the Southwest.Quarter -of
Section 51 Township 7 North, Range 68 West of the 6th
P.M., City of Fort Collins, County of Larimer, State of
Colorado -- the Lake Canal Company ditch
Dear Mr. McCory:
I am the Manager of the Lake Canal Company.
The Lake Canal Company ditch runs through the proposed
location of this subdivision.
The Lake Canal Company has, seen what is labelled Final Utility
Plans.
The Lake Canal Company has an obligation to operate, maintain
and repair its ditch through this area and must have continued
access to its ditch.
The Directors tentatively approved the storm drainage plan.
However, for there to be final approval, the following items must
be addressed:
1. There needs to be a written agreement protecting the
rights and obligations to the Lake Canal Company. Any agreement
would have to address the terms of any agreement to receive storm
run-off into the ditch.
2. The Lake Canal Company would also in this agreement
expect to address any charges, if any, for the continuing expenses
and administrative costs in connection with the receipt of any
storm water. Any facility adds to time spent to operate the
Company.
3. Finally, the Lake Canal Company will have to spend money
to review the engineering data which is being submitted in
connection with a request to channel storm water into the Lake
