Approval to start on -site road improvements on or before Monday, October 13, 1997. The Land Use Code (section 3.3.2(A)(2) does not permit street improvements to occur until plans are approved. These plans are not yet approved. 4. Final Engineering review on or before Thursday, October 16, 1997, with prior approval of development agreement. It is likely that the current engineering review will be completed prior to October 16. However, street plans and profiles have just recently been submitted for review and, historically, these plans require multiple rounds of review before they are approved. (Engineering staff has consistently told this to you.) A draft of the development agreement could be provided by October 16, but it will not be finalized until plans are approved. 5. Final draft of development agreement by October 16, 1997, such that after the Planning and Zoning hearing City approval signatures can be obtained by October 17. As noted in #4, a draft of the development agreement could be provided by this date but a final version is not prepared until all plans are finalized. The Land Use Code does not permit the recording of final plans until the development agreement has been fully executed. 6. In lieu of item #5, release of full building permit for the entire project if approval processes cannot be completed by October 16, 1997, as long as all parties are agreeing in principal with the contents of the development agreement. As noted in #5, the Code does not allow the recording of final plans until the development agreement is executed which does not occur until the engineering plans are approved. The City does not allow building permits to be issued until recording of final plans occurs. I trust this provides some background to the points raised in your letter. O. Box 2127 Fort Collins, CO 80522 Dear Mike: This is in response to the concerns that were raised in your letter to David Neenan dated September 19, 1997. I received a copy of this, you may recall, from David prior to his leaving the country. Before I get started I think it is important to understand that the staff did not "unilaterally" change the hearing date. The date was changed due to unresolved issues in the submittal materials. As you know, we have tried to cooperate with expedited review and work with the applicant to try to meet with what has consistently been termed an unrealistic time line. However, you have not been able to resolve what have been ongoing issues to the level they can be scheduled for a hearing. The following are responses to the individual points of the letter provided by the Development Review staff: Approval from Stormwater to start the stormwater utility work on or before September 29, 1997, and reference to an original easement agreement between the Coy Ditch Company and New Belgium. Stormwater utility work cannot occur until a project has been approved. This has not occurred yet. In fact, Stormwater has not seen the required revisions yet. The original easement agreement is not valid anymore since it was obtained for the first phase of the project which has been completed. Since we are dealing with a new submittal which includes phases that were not included in the original submittal, a new easement agreement is required. 2. Approval from Water Utilities to start the water utility work on or before Monday, September 29, 1997, and reference to an original easement agreement between the Coy Ditch Company and New Belgium.
