I just wanted to update you on a situation with the New Belgium Brewery that you are
likely to hear about.
New Belgium needs to place a storm drainage pipe under the Coy Ditch in order to get
the stormwater flows under Buckingham and to the river.
The City (Natural Resources) has 10% ownership in this ditch. All the other owners
have signed the easement agreement at this time except the City. I spoke with Paul
Eckman in trying determine who in the City has the authority to sign this document,
and it appears that in accordance with Section 23-111 of the City Code, City Council
is the only authority for the granting/conveying interests of City property. This in
part is due to the fact that from my understanding there is not a board or a company
for this ditch that has the ability to make these decisions.
This means that this easement document will need to go to City council for two
readings. I have a call into Ron Mills about getting this on the next City Council
meeting. This time frame will probably not fit with the construction schedule that
Neenan has. I have not yet called Michael Stajduhar of Neenan Co. yet to let him know
this, but in my conversations with him this week so far was that they were wanting to
do this work next week.
I don't know if that is feasible without having an easement granted for the crossing.
Also at this time plans are not approved for this crossing. We have been working with
them and plans are approved for the sanitary sewer extension into the site so that
they can start on that work. We are also working with them to get the portion of the
stormdrain approved that goes under Buckingham so that it can be installed at the same
time the road is cut and closed for the sewer line installation. Stormwater does not
intend to approve the stormdrain crossing work under the ditch at this time. My
understanding is that they are still working with the engineer on the design of this
line into the detention pond.
We did receive this easement document a couple of weeks ago. Since receiving it I
have been trying to determine who owned the shares in an effort to determine who would
need to sign the document. I felt the department who owned the shares needed to know
what was going on and could tell me who had the legal right of signature.
Tom Shoemaker did verify to me that they do own the shares for the Coy Ditch and asked
that Rob Wilkenson review and approve the crossing. I have yet to talk to Rob, so I
do not know if he has looked at the crossing and what his comments might be. I will
talk to Rob and make sure he takes a look at the plans and that his comments are
forwarded on to the engineer.
