Member Chapman seconded the motion. Member Gavaldon did not support the motion based on the mitigation to the adjacent neighborhood and the requirement for off -site improvements. The motion was approved 6-1 with Member Gavaldon voting in the negative. OTHER BUSINESS Proposed Amendment to Section 2.8.4(b) of the Land Use Code, Ordinance No. 153, 1997. Deputy City Attorney gave the staff presentation on this item that would allow the Director to convene a neighborhood meeting for "quasi-judicial' rezonings in those circumstances where there is known controversy or where the quasi-judicial rezoning presents significant neighborhood impacts. Member Craig asked that in the notice to the residents it should state that there will not be a neighborhood meeting held, and if they are an interested party then they should make a phone call or come to the P & Z Board Meeting. Member Weitkunat moved that the Board recommend adoption of Ordinance No. 153, 1997 Amending Section 2.8.4(b) of the Land Use Code. Member Gavaldon seconded the motion. The motion was approved 6-1 with Member Craig voting in the negative. There was no other business. Member Davidson also asked for more detail on the walls on each side of the entrance. Mr. Hendee replied that they have added additional landscaping to break up the edge. He stated that it would be possible to add the additional trees along Buckingham if there is no technical problem. He stated that they would be grading the detention area and that would improve the area visually. Mr. Hendee committed to adding additional trees at the rear end of the detention area instead of along Buckingham. Member Gavaldon asked about the traffic impact report and the level of service report. Matt Delich, prepared the Traffic Analysis, reported that the levels E and F occur now because there is no facilities there. Whether there are facilities there, is not in the control over this development because it is off -site and cannot be the responsibility of this development. It would be other development that would make those improvements. Member Gavaldon asked about how this development could mitigate to bring them in compliance with acceptable levels of service with off -site improvements for pedestrians. Mr. Delich replied that there will be sidewalks on the property and there are sidewalks on the property right now. If there were sidewalks off -site then it would meet the criteria and be level of service A and B. Chairperson Bell asked about the off -site improvement requirements for this project. Planner Shepard replied that the decision was made in evaluating the Traffic Impact Study that the impact created by the net increase of employees due to the expansion, did not warrant the off -site improvement of construction of sidewalks off -site along Buckingham Street. Member Weitkunat moved that the Board approve the 25 foot setback modification from 30 feet. Member Chapman seconded the motion. The motion was approved 6-1 with Member Gavaldon voting in the negative. Planning and Zoning Board Minutes October 16, 1997 Page 14 Project: New Belgium Brewery Expansion, Project Development Plan and Replat, #1-95B. Project Description: Request for a PDP for the expansion of the New Belgium Brewery. The request includes an enlarged site for additional office space, two new warehouses, new brewhouse, additional fermentation tanks, and employee parking. The request also includes a replat to include newly acquired property. The expansion will add 41,225 s.f. for a new total of 69,025 square feet plus the additional fermentation tanks which are not enclosed. The site contains 7.17 acres and is located at the corner of Linden and Buckingham Streets. The property is zoned "I" Industrial. The request is being considered under the Land Use Code. Recommendation: Approval Ted Shepard, Senior Planner gave the staff report recommending approval. Bruce Hendee, BHA Design, representing the applicant gave a history of the property and the Brewery. Mr. Hendee spoke about the phased expansion of the project, the overall site plan, the requested modification for the height of the fermentation tanks being 50 feet, the shadow analysis, the requested modification for the setback encroachment of the brewhouse, landscaping, the building facade, the location of the fermentation tanks, screening of the fermentation tanks and the cooling towers for the brewhouse extending above the building height. Member Craig asked what existing trees would be taken out. Mr. Hendee replied that 5 trees would be removed and relocated on the site. Member Weitkunat asked about the requirements of screening in the I, Industrial Zoning District from neighborhoods. Planner Shepard replied that the neighborhood does not abut this development, therefore the requirements are less. Member Davidson asked for more trees along Buckingham for additional screening from the neighborhood.
