Project Ed and Marsha Fleming Dear Mr. Jones: Via Fax 2-13-2000 Certified Return Receipt US Mad 2-14-2000 4 We were surprised to be informed by a friend in Fort Collins that a deadline of March 20`n, 2000 is in place concerning our development Glenmoore P.U.D. on Taft Hill Road. Dick Rutherford of Stewart and Associates, our long time engineer, told us in early December 99 that our subdivision had been approved. In late December 99 he related that he was just waiting for the City Attorney to draw up and finalize the subdivision, with a tentative TOTAL completion date in the middle of January 2000. Upon receiving the deadline information on February 11, 2000, we called Mr. Rutherford at his office on February 12, 2000. He related he was in receipt of the letter and deadline as of late December 99, but that the subdivision was in the FINAL COMPLETION stage and he saw no problem being in TOTAL COMPLETION and ready to proceed with development prior to the March 20', 2000 deadline. Needless to say we have been working on this for very long time with Mr. Rutherford, and at least three different planners of the City of Fort Collins. If in fact all areas are completed by Mr. Rutherford and the FINAL APPROVAL through the Planning Department, and City Attorney are just days away, we are more than elated. At this time we would like to verify with you, via this Ietter, that the Glenmoore Subdivision P.U.D. is in the final stage and approved per Mr. Rutherford's comments to us, on several occasions as mentioned above.
