viable land use on this site. The "part of a center" and
"mixed use" criteria are questionable, as presented.
7. The building must be equipped with an automatic fire sprinkler
system. A fire hydrant must be provided at the entry to the
property at Boardwalk. Drive.
8. The 80' Harmony Road setback and design standards and
guidelines must be met as specified in the plan. This plan
would appear to conform.
9. A hazardous materials management plan may be necessary. Ron
Gonzales of the Poudre Fire Authority should be contacted to
determine if this is necessary. He can be reached at (970)
221-6570.
10. The Whaler's Way access into this property is not aligned with
the access to the office park to the north and it is not at a
90 degree angle to Whaler's Way.
11. What is coming out of the "heavy duty" chimney on the
building? Will there be wood burning in the restaurant? The
City has stringent air quality emissions standards that must
be met. A fireplace would have to be gas -fueled.
12. You will need to have a Colorado registered engineer sign the
utility plans and drainage documents. This must be done by the
re -submittal date of May 4.
13. City staff has concerns about the nature of the neon lighting
being proposed on the building.
14. The building elevations should be labeled north, south, east,
and west.
Copies of the Project Comment Sheets for the Rafferty's P.U.D. are
enclosed with numerous red -lined plans containing comments. These
plans should be returned with your revisions on May 4, 1995.
This completes the review comments at this time. Additional
comments may be forthcoming as the various departments and
reviewing agencies continue to review this request. Please be aware
of the following dates and deadlines to assure your ability to stay
on schedule for the May 22, 1995 Planning and Zoning Board hearing:

May 4, 1995. Please contact me for the number of folded revisions
required for each document.
PMT's, renderings, and 8 folded copies of final revisions (for the
Planning and Zoning Board packets) are due by 3:00 p.m. on May 15,

Dear Steve,
Staff has reviewed your documents for the Rafferty -Is P.U.D.
Preliminary that were submitted to the City on March 20, 1995 and
would like to offer the following comments:
1. The Site Plan should note that gas meters and transformers
will be screened from view with fences/walls/landscaping, etc.
The transformer should not be located along a street frontage.
2. The Site Plan should note that all roof -top mechanical will be
screened from view in all directions.
3. Trash enclosures should be located in areas that are not
visually obtrusive and should be of the same material as the
buildings. This should be noted on the Site Plan.
4. An overall utility plan for the entire property between
Harmony Road, Boardwalk Drive, Whaler's Way and the
residential development to the east was not submitted.
Utilities for the office buildings should be shown in a
preliminary form.
5. What is the overall development plan for the entire
undeveloped area and what is the Phase I plan for Rafferty's
Restaurant? From the information provided in the Land Use
Breakdown on the Site Plan it is difficult to distinguish
between the overall and a phase.
6. Who controls/owns this overall site? The entire property
should be preliminarily planned as an office/restaurant park
and be able to meet the All Development Criteria of the Land
Development Guidance System. It doe not appear that the plan
before the City today will do that (one specifically being
Criterion A-2.6 Pedestrian Circulation). The limited
information provided for the entire property does not
represent a use that is visually and functionally part of an
office or business park. The Business Service Uses point chart
will have to be evaluated to determine if the project as
submitted can satisfy enough of the criteria to deem it a
