Dear Bob:
hi response to your letter of March 20, 1998 to Mr. Jim Sell and our phone conversation regarding the
Hearthfire PUD, 2"' Filing, Final PUD application, the current owner, and developer Hearthfire, Inc., aka
Richard's Lake Development Company, is hereby requesting that staff does not take this application to the
Planning and Zoning Board at. this time Although there has not yet been a resubmittal;to the City, there has
been numerous items related to staff comments which.have been addressed and several which were resolved with
the final approvals of the,1` Filing approvals in December of 1997. These,include:

1. As you are aware, the 2".. Filing is the second phase of the Hearthfire PUD which was approved in
1996 and the Is' Filing, Final was .approved by the Planning and Zoning Board on January 26,
1997.
2. The Developer had concentrated on the final engineering approvals on the 1'` Filing which were
finalized with the signing of the Development Agreement on October 6, 1997 and the recording of
the Plat on December 19, 1997.
3. The development construction of the 1'` Filing began in January of 1998 and it is the intent of the
Developer to continue with the construction of the 2"d Filing once approximately 50% of the lots in
the I' Filing have been sold.
4. The civil engineer, Shear Engineering Corporation, has been working on addressing the comments
from Engineering staff, ELCO, Boxelder and Stormwater Utility staff. These include:
a. ELCO-completion of the water system improvements design to comply with the Districts
regulations and comments.
b. Engineering -have completed the storm sewer plan and profile sheets; have begun the design
of County Road 13 adjacent to the property; all utility crossings have been identified and
will be shown on the revised plans..
c. Boxelder-have revised plans to remove services from manholes.
d. Stormwater Utility -have sized storm water pipes; a final drainage report for the entire site
had been prepared and resubmitted as ,part of the l StFiling. This .included the 2"d Filing in
order to be sure that all storm pipe in the I' Filing was sized accordingly. After approval of
this_final drainage, report, staff agreed with the Shear..Engineering that a SWMM analysis
was not necessary. This analysis; was prepared and approved ;after .the staff comments of
8/18/97 were prepared.. Storm sewer plan and profile sheets have been completed.
5. Natural Resources requested that the wetlands created in the I' Filing as mitigation for the 2"d
Filing be shown on the site plan. These areas have been shown on the I' Filing site plan and are

On March 20, 1998 you were sent a letter requesting documentation that you
were actively pursuing the Heanthfire PUD, Second Filing, Final. I have
reviewed your response with other development review staff and determined that
there has been sufficient activity related to this project to avoid taking this project
to the Planning and Zoning Board. This project will be permitted to continue
processing under the Land Development Guidance System until an additional
reassessment is done later this year.

currently under construction. Prior to the resubmittal, these areas will be shown on the 2nd Filing
site plan.
6. Larimer County comments included the request for a copy of the wetland mitigation report. A copy
has been sent to the County. Also, as discussed above, the design of County Road 13 has begun and
should be completed at resubmittal.
7. Mapping Department stated that the right-of-way cannot be dedicated by annexation. This right-of-
way has been dedicated to the City by a separate document and we are awaiting the approval by
Latimer County on the Jewitt Amended Exemption before submitting to the City for annexation of
the right-of-way. This also includes the annexation of County Road 13 into the City.
8. Current Planning comments have been addressed as follows:
a. The plans for County Road 13 have been prepared by the civil engineer and are 95%
complete.
b. Wetland mitigation measures including the preparation of the mitigation plan which
replaces disturbed wetlands at a rate of 1.5 to 1 have been satisfied with the approval of the
1 Filing. As noted above, these mitigated areas are soon to be constructed as part of the ISt
Filing and the revised site plan will show the areas where wetlands were created to
compensate for lost wetlands in the 2nd Filing.
c. A detailed plan and report which analyzed the effects of urban runoff into the wetlands and
Richard's Lake was submitted and approved by staff as part of the l' Filing approval.
Again, this was after the comments for the 2"d Filing were prepared by staff.
9. As a requirement of a subdivision plat and per state statute, Frederick Land Surveying has
monumented the boundaries of the plat limits for the 2"d Filing since the August staff comments.
10. During the design and the construction of the sanitary sewer, water mains, electric, phone and gas
distribution systems for the I" Filing, we have worked with the utility companies to have these
facilities sized accordingly to accommodated the 2"d Filing and these services will be stubbed to the
property line between the I" and 2nd Filings during construction.
Bob, although there has not yet been a resubmittal of the 2nd Filing, as you can see there has been significant
work done to address the staff comments and with the construction of the I' Filing, all improvements have been
sized to accommodate the future phase. A final note is that the Developer completed the purchase of the entire
Hearthfire PUD property (Filing I & 2) as well as the 35 acre parcel to the North in October of 1997 with every
intent to complete the development of both phases within the next 3 to 4 years. We will continue to address the
staff comments and revise the plans as necessary and hopefully within the next 90-120 days, resubmit the
revised plans to the City.
