NOTICE
TO ALL PERSONS INTERESTED:
PLEASE TAKE NOTICE that the City Council of the City of Fort Collins has adopted a
Resolution initiating annexation proceedings for the Snyder Annexation, said Annexation being
more particularly described in said Resolution, a copy of which precedes this Notice.
That,. on August 1, 1995, at the hour of 6:30 p.m., or as soon thereafter as the matter may
come on for hearing in the Council Chambers in the City Hall, 300 Laporte Avenue, Fort Collins,
Colorado, the Fort Collins City Council will hold a public hearing upon the annexation petition for
the purpose of finding and determining whether the property proposed to be annexed meets the
applicable requirements of Colorado law and is considered eligible for annexation. At such hearing,
any persons may appear and present such evidence as they may desire.
The City of Fort Collins will make reasonable accommodations for access to City services,
programs and activities and will make special communication arrangements for persons with
disabilities. Please call M-6515 for assistance.

RESOLUTION 95-92
OF THE COUNCIL OF THE CITY OF FORT COLLINS
FINDING SUBSTANTIAL COMPLIANCE AND
INITIATING ANNEXATION PROCEEDINGS
FOR THE SNYDER ANNEXATION
WHEREAS, a written petition, together with four (4) prints of an annexation map, was
heretofore filed with the City Clerk requesting the annexation of certain property to be known as the
Snyder Annexation; and
WHEREAS, the Council of the City of Fort Collins desires to initiate annexation proceedings
in accordance with law.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That the Council hereby accepts the annexation petition for the Snyder
Annexation, more particularly described as located in the County of Larimer, State of Colorado, to
wit:
A tract of land situate in the Southwest 1/4 of Section 2, Township 7 North, Range
69 West of the Sixth P.M., County of Larimer, State of Colorado, which, considering
the West line of said Southwest 1/4 as bearing N00°04'30"W and with all bearings
contained herein relative thereto, is contained within the boundary lines which begin
at the Southwest Corner of said Section 2, and run thence N89°59'30"E 330.00 feet
along the South line of said Southwest 1/4; thence N00°04'30"W 415.93 feet; thence
N55031'08"W 400.69 feet to a point on the West line of said Southwest 1/4; thence
S00004'30"E 642.82 feet along said West line to the point of beginning, containing
4.0104 acres, more or less, and being subject to a right-of-way for North Shields
Street over the West 30.00 feet thereof.
Section 2. That the Council hereby finds and determines that the annexation petition and
accompanying map are in substantial compliance with the Municipal Annexation Act.
Section 3. That the Notice attached hereto be adopted as a part of this Resolution. Said
Notice establishes the date, time and place when a public hearing will be held regarding the passage
of an annexation ordinance pertaining to the above described property. The City Clerk is directed
to publish a copy of this Resolution and said Notice as provided in the Municipal Annexation Act.

Mr. and Mrs. Snyder constitute 67% of the owners who own 77% of the area proposed for
annexation. State law requires more than 50% of the owners who own more than 50% of the
proposed area sign the annexation petition. Gallagher Oil Corporation, the owner of the Gas -A -Mat,
has not responded to correspondence from the Snyders' attorney pertaining to the Annexation
Petition.
The properties are currently zoned C, Commercial, in the County. The proposed zoning for this
annexation is C, Commercial with a condition that the permitted uses be limited to gas stations and
those. uses permitted in the B-L, Limited Business Zoning District. The proposed zoning creates the
fewest non -conforming uses and is compatible with the surrounding zoning.
Planning and Zoning Board Recommendation:
The Planning and Zoning Board will conduct a public hearing on the annexation and zoning request
at its regular monthly meeting on June 26, 1995, and will make its recommendation at that time. The
Board's recommendation will be forwarded to the City Council in time for the first readings of the
ordinances annexing and zoning the area, scheduled for August 1, 1995.

Resolution 95-92 Finding Substantial Compliance and Initiating Annexation Proceedings for the
Snyder Annexation.
RECOMMENDATION:
Staff recommends adoption of the Resolution.
EXECUTIVE SUMMARY:
The property being considered for annexation is approximately 4.6104 acres in size and is located
at the northeast corner of the intersection of West Vine Drive and North Shields Street. The
annexation is comprised of one parcel with three owners. Two of the owners (67%), Ben and
Rosemarie Snyder, own approximately 3.07 acres of the 4.0104 total acres (77% of the area). The
Snyders have voluntarily requested to be annexed into the City of Fort Collins as a 50%+ voluntary
annexation. The property is currently zoned C, Commercial, in the County. The proposed zoning
for this annexation is C, Commercial with a condition that the permitted uses be limited to gas
stations and those uses permitted in the B-L, Limited Business District.
The proposed Resolution determines that the annexation petition complies with the Municipal
Annexation Act. The Resolution also determines that a hearing should be established regarding the
annexation and directs that notice be given of the hearing. The hearing will be field at the time of
first reading of the annexation and zoning ordinances on August 1, 1995.
The property is located within the Fort Collins Urban Growth Area. According to policies and
agreements between. the City of Fort Collins and Larimer County contained in the
INTERGOVERNMEN,rAL AGREEMENT FOR THE FORT COLLINS URBAN GROWTH
AREA, (specifically Policy 2.10 c) the City will agree to, consider annexation of property in the
UGA when the property is eligible for annexation according to state law.
This property has 330 feet of its total boundary contiguous to existing City limits, exceeding the
minimum of 298.24 feet required to achieve 1/6 contiguity. The annexation consists of one parcel
of land with three owners: The owners are as follows:
