It is zoned C-Commercial in Larimer County and is eligible for annexation to the City of Fort Collins. It is proposed to be zoned C-Commercial in the City of Fort Collins. The 0.64 acre lot in the Southwest comer of the proposed Annexation contains the existing Gas -A -Mat gasoline sales and convenience store which is a permitted use. The 0.79 acre lot in the Southeast comer of the proposed Annexation contains a mobile home and a steel shop building. The North tract is vacant land at this time and preliminarily has a proposed use as a single family lot which is also a permitted use. The C-Commercial zoning would allow the Gas -A -Mat to be a conforming use and to continue to serve the Northwest comer of the City with gasoline sales. The City will be able to collect sales and property taxes from the existing business. The site is in the Urban Growth Area and one of its policies is to develop inside the City of Fort Collins if it is eligible for annexation. Snyder Annexation and Zoning, #22-95-A June 26, 1995 Page 3 build a single-family house on the northern parcel. Staff recommends that this parcel be zoned R-L, Low Density Residential. This would allow a single-family house as a use -by -right. Staff does not feel that a future development proposal for one single- family house needs to go through the P.U.D. process. Annexing the property will require all commercial signs to conform to the City's Sign Code within five years of the date of annexation. All portable signage must be removed from the site within ten days after the date of annexation. This will be enforced by the Zoning Department. FINDINGS OF FACT/CONCLUSION: 1. The annexation of this property is consistent with the policies and agreements between Larimer County and the City of Fort Collins as contained in the INTERGOVERNMENTAL AGREEMENT FOR THE FORT COLLINS URBAN GROWTH AREA. 2. The area meets all criteria included in State law to qualify for a 50°s+ voluntary annexation to the City of Fort Collins. 3. On June 20, 1995, the City Council approved a Resolution which accepts the annexation petition and determines that the petition is in compliance with State law. The Resolution also initiates the annexation process for this property by establishing the date, time and place when a public hearing will be held regarding the readings of the Ordinances annexing and zoning the area. Public hearing and first reading of the Ordinances annexing and zoning the property will be considered by City Council on August 1, 1995. 4. The staff recommendation that the two south parcels be zoned "c", Commercial with a P.U.D. condition and the north parcel be zoned R-L, Low Density Residential, is in conformance with the policies of the City's Comprehensive Plan. S. All commercial signs must conform to the Citys Sign Code within five years of the date of annexation. 6. RECOMMENDATION: Staff recommends approval of the annexation and that the two south parcels be zoned C, Commercial with a P.U.D. condition and the north parcel be zoned R-L, Low Density Residential. COMMENTS The following annexations have occurred surrounding this property: N: none, existing County S: Capital Hill Addition, June 1907, zoned R-H, High Density Residential and N-C-M, Neighborhood Conservation Medium Density District E: none, county; Service Center 3rd and 4th Annexations, March 23, 1987, zoned R-C, River Corridor District W: none, county; Granada Heights Annexation, June 21, 1977, zoned R-M-P, Medium Density Planned Residential District. The property is located within the Fort Collins Urban Growth Area. According to policies and agreements between the City of Fort Collins and Larimer County contained in the INTERGOVERNMENTAL AGREEMENT FOR THE FORT COLLINS URBAN GROWTH AREA, The City will agree to consider for annexation, property in the UGA when the property is eligible for annexation according to State law. Under Colorado law, this annexation qualifies as a 501+ Voluntary Annexation. A 5001+ voluntary annexation consists of an Annexation Petition signed by less than 10096 but more than 50% of all property owners and all residents of the area desiring to be annexed. Two of the owners (67%), Ben and Rosemarie Snyder, own approximately 3.07 acres of the 4.0104 total acres (77% of the area) and have filed the petition for annexation. This type of voluntary annexation must also satisfy a minimum 1/6 contiguous boundary requirement. In this instance, this property has a total boundary length of 1789.44 feet. At a minimum, this property must have at least 298.24 feet of boundary contiguous to the existing City limits. This property's south 330 feet of boundary is contiguous. The applicant requests that the property be annexed and zoned C, Commercial with a condition that the permitted uses be limited to only gas stations and those uses permitted in the B-L, Limited Business District. Staff recommends that the two south parcels be zoned "c", Commercial with a P.U.D. condition. This allows the existing uses to be permitted uses. However, any redevelopment of these two parcels would have to be submitted as a P.U.D. subject to the requirements of the L.D.G.S. The area to be annexed consists of three meets and bounds parcels with three different owners. Two of the owners (670), Ben and Rosemarie Snyder, own approximately 3.07 acres of the 4.0104 total acres (7796 of the area). The Snyders have voluntarily requested to be annexed into the City of Fort Collins as a 5006+ voluntary annexation. They have requested that the entire property be zoned C, Commercial with a condition that the permitted uses be limited to gas stations and those uses permitted in the B-L zoning district. RECOMMENDATION: Staff recommends approval of the voluntary annexation and that the two south parcels be zoned "c", Commercial with a P.U.D. condition and the north parcel be zoned "R-L", Low Density Residential. EXECUTIVE SUMMARY: This is a request to voluntarily annex and zone approximately 4.01 acres located at the northeast corner of West Vine Drive and North Shields Street. The annexation consists of three meets and bounds parcels. The southwest 170' x 214' parcel (approximately .94 acres) is owned by Gallagher Oil Corporation and is the current location of the Gas -A -Mat. The southeast 160' x 214' parcel (approximately .79 acres) is owned by Ben Snyder. There is currently a metal building occupied by Apex Gutter Company and a mobile home located on this parcel. The remaining parcel (approximately 2.28 acres) is owned by Rosemarie Snyder and is currently undeveloped. The property has 330 feet of its total boundary contiguous to existing City limits, exceeding the minimum of 298.24 feet required to achieve 1/6th contiguity.
