in the Stormwater Utility Department. An escrow has been setup with the
City for the reconstruction of the inlet. The developer is currently working
with the contractor and Whiting Petroleum to have this inlet reconstructed
and hopefully this work will be completed in the next 30-60 days.
b. The necessary off -site easements still have not been submitted. The
documentation must be submitted and reviewed by City staff before this
request can go to public hearing.
- Two (2) drainage easements are required from Water Supply and Storage.
Their attorney has included both of the easements in one agreement and has
drafted copy of an "Agreement to Allow Discharge of Drainage Water into
the Water Supply and Storage Company's Reservoir" and three (3) copies are
included in this resubmittal for staff review and approval. The Developer's
attorney is currently reviewing this document and we would request that
staff do the same. Once all parties agree upon the final language on the
Agreement, the Developer and Water Supply will formalize and sign the
easement documents and return to the City for recording.
c. The capacity of the storm water Swale along the west side of the property, along
County Road 13, needs to be checked. The plans show that the roadside swale is
to be filled.
- See comments from Shear Engineering.
d. There are still some off -site easements/agreements from Water Supply & Storage
Company that must be submitted to the City.
- Is this a repeat of comment 6.b? Please see response above.

7. Planning
a. Red -Lined Site and Landscape Plan
- The "G" has been changed to a "C" under Landscape Assurances - Note # 1.
- The offsite information for the extension (wetlands and topo) has been
shown on Sheet 2 of 2 of the Final Site and Landscape Plan.
- A sight distance triangle has been added to the Site and Landscape Plan at
Bateleur Lane and CR 13.
- The existing wetlands do encroach into Lots 27 - 32. As discussed in the
previous submittal of June 19, 2000, Sheet 2 of 2 of the Final Site and
Landscape Plan shows a total of .15 acres of wetland area is within these
lots. As part of the wetland mitigation plan for the entire project, both
Filings I & 2, new wetlands were created within the first filing to
compensate for the wetlands within these lots.
I believe this addresses all of the comments since the last submittal. Please review the enclosed
information and should you have any questions, feel free to give me a call.

Developer and Water Supply will formalize and sign the easement
documents and return to the City for recording.
b. The plans for Douglas Road improvements need to be approved before the City
can sign off on the Hearthfire PUD, Second Filing plans.
- The developer has been working with Cam McNair to try to resolve the
easement issues with the Douglas Road improvements and there is currently
a restriction in the development agreement for the V filing related to the
required improvements. We do not understand why the 2"d filing plans
cannot be signed off until the Douglas Road plans are approved because
there are already restrictions in place to prohibit more than 90 permits being
issued for the development until the Douglas Road improvements are
completed.
c. There is a concern about Town Center Way. This area is not very developable
because there probably are wetlands here. It could/should be more of a
"driveway" than a street. The Water Supply & Storage Ditch Company must be
involved in this.
As stated above, after meeting with members of the City staff on site on
May, 19`h, it was determined that Town Center Way may or may not be
extended too much further south of the Hearthfire property boundaries in the
future. If and when the property to the south develops, the current owners,
The Water Supply and Storage Company, will need to prepare development
and utility plans to show how this area could be developed. Therefore, as
discussed in the meeting and agreed to by staff and Water Supply, that the
developer would like to dedicate the required ROW to the City for Town
Center Way at this time and install and stub out any required utilities to the
south property line as development of this 2"d filing occurs. When the
development agreement is prepared by the City, we would request the actual
construction of the walks, curb, gutter and paving not be required at this
time, but that a escrow be established for future construction of the road if
development occurs in the future. Also, Water Supply has requested that a
note be placed on the Final Plat for lots 25 and 26 that states "Town Center
Way is a dedicated public street right-of-way and construction of this street
may occur at any time in the future." This note has been added to both the
Final Site & Landscape Plan as well as the Final Plat. Also, Water Supply
has requested that a fence be install along the right-of-way adjacent to lots
25 and 26. A note has been added to the Final Site and Landscape Plan that
states: "A two -rail, white vinyl fence shall be installed along the property
lines of Lots 25 and 26 adjacent to Town Center Way at the time these lots
are developed."
d. Red lined Site and Landscape Plan
- The curb cut was eliminated where the Emergency Access Easement meets
CR 13.
- Bollards have been added to the Final Utility Plans at the pedestrian trail at
CR 13 and Inverness Drive.
e. The new note as indicated in the engineering response letter has been added to
the Final Site and Landscape Plan.

6. Stormwater Utility
a. The overflow from the ponds in the Hearthfire PUD, First Filing could affect the
Hearthfire PUD, Second Filing. Until this issue is resolved, staff will not
schedule this item for public hearing.

accommodate an 8' bike lane once the ultimate street section is constructed
as well as an 8' bike lane on the west side, again once the ultimate street
section is constructed. This ultimate street section is not required until such
time as the properties to the west of CR 13 redevelop.
c. It appears that the previous comments have been addressed. The
pedestrian/bicycle trail connections along County Road 13 look good. The small
scale plan makes it difficult to review the internal pedestrian system.
- Items noted - no comment required.
d. The combined Site & Landscape Plan at such small scale is very difficult to read
and review.
- This item was discussed with Steve Olt and Current Planning is not going to
require the plans be redraw at a different scale.
e. Red lined Site and Landscape Plan
- Several items were circled on the Site and Landscape Plan reviewed by Mark
Jackson, dated 07/00, but there was no indication if revisions were required.
4. Technical Services Department (Mapping & Drafting)
a. This subdivision plat must show the Recording information for Hearthfire Way
and Hearthfire Drive.
- The dedication of Hearthfire Way and Hearthfire Drive has not yet been
recorded. The dedication is currently scheduled to go before the Council on
Tuesday, October 17d. Once the dedications are approved, they will be
recorded with the County Clerk and the requested information can be added
to the plat.
b. The Recording information for the portion of Hearthfire Drive to be dedicated
by separate document must be shown on the subdivision plat.
- See above response (4.a).
c. All mylar originals (subdivision plat, Site Plan, Landscape Plan. Utility plans,
etc.) must be able to be reproducible (text lines, line weight, etc.).
- Item noted and once the City approves all plans, original mylars will be
submitted.
d. The plat boundary closes and the legal description matches the plat.
- Items noted - no comment required.
5. Engineering Department
a. The applicant has not yet provided the necessary off -site easements and street
right-of-way documentation. This includes right-of-way for County Road 13 and
an easement from Water Supply & Storage. The documentation must be
submitted and reviewed by City staff before this request can go to public
hearing.
- On September 21" and September 25th, Janelle Kechter of March & Liley
submitted unsigned copies of both the required ROW dedication and
easement forms to both Sherri Wamhoff and Rusty McDaniel of Latimer
County for review (two copies are enclosed). Once staff and the County
approve these dedication and easement forms, the Developer will sign them
and have them recorded with the County Clerk. Two (2) additional drainage
easements are also required from Water Supply and Storage. Their attorney
has included both of the easements in one agreement and has drafted copy of
an "Agreement to Allow Discharge of Drainage Water into the Water Supply
and Storage Company's Reservoir" and three (3) copies are included in this
resubmittal for staff review and approval. The Developer's attorney is
currently reviewing this document and we would request that staff do the
same. Once all parties agree upon the final language on the Agreement, the
owners of that property will be required to provide the required information.
To continue see this comment again is a bit frustrating. We contacted staff
again on several occasions to discuss this matter. At the last conversation we
were told that the item would be discussed between staff and Mr. Tom
Shoemaker. As of this date we have heard no additional response. Due to the
required resubmittal date deadline, we have mapped the wetlands areas to the
south as requested and have included them on Sheet 2 of 2 of the Final Site
and Landscape Plan (contextual plan) for your review.
2. Poudre Fire Authority
a. WATER SUPPLY-...
- This has been addressed in previous comments and the requirements for fire
hydrants and minimum delivery and pressures will be met for this residential
project.
b. ADDRESS NUMERALS:...
- Again, this comment has been addressed in previous comments and a note is
on the Lighting Legend on the sheet 1 of the Final Site and Landscape Plan
addressing this item.
c. CUL-DE-SAC: A dead-end street cannot exceed 660' in length. The turn -around
at the end of the street must have an outside turning radius of 40' or more, and
an inside turning radius of 20'. Short fire lanes are permitted to facilitate a
second point of access when a street is greater than 660' in length. All structures
beyond the 660' limit must be fire sprinklered if a second point of access cannot
be provided.
- Again, this comment was addressed in the last resubmittal of June 19d' as
follows: On May 8`h, Brian Shear and myself met with Ron Gonzales of the
Poudre Fire Authority to discuss an emergency access point at the end of this
cul-de-sac. Ron stated that the emergency access would be acceptable as long
as the roadway was made of road base and that a 2" cover of crushed
limestone (so it would match the pedestrian trails) was installed over the road
base. We believe that this item has been addressed and should not be a
continual issue.
d. STREET NAMES: Street names shall be reviewed and verified by L.E. T.A. prior
to being put into service.
- Again, a repeated comment. We have had L.E.T.A. review street names on
numerous occasions. As of this date, all street names on the plat and site and
landscape plans have been approved by L.E.T.A.
3. Transportation Planning
a. Have site distance issues been addressed regarding the proximity of Bateleur
Lane to the curve at County Road 13 & Inverness Street?
- A sight distance triangle has been added to the Final Site and Landscape Plan
at Bateleur Lane and CR 13.
b. What is the agreement for improvements along County Road 13? Have bicycle
lanes been provided along this Collector level road?
- The developer is only required to make interim improvements to CR 13 at this
time. These include and are shown on Sheets 13 of 34 and 22 of 34 of the
"Final Utility Plans" as prepared by Shear Engineering Corp. These interim
improvements include curb, gutter, detached walks and 30' of pavement width,
20' east of the centerline and 10' to the west. The 20' on the east side will

Resubmittal - Response Letter
Dear Steve:
Enclosed please find ten (10) copies of the revised Final Site and Landscape Plan as well as
seven (7) copies of the revised Final Utility Plans as prepared by Shear Engineering Corporation,
one (1) copies of the revised Drainage Report, seven (7) copies of the revised Final Plat as
prepared by Fredrick Land Surveying and ten (10) copies of the Contextual Plan for the Wetland
areas (Sheet 2 of 2 of the Site and Landscape Plan), for the Hearthfire P.U.D., Second Filing,
Final. (As well as the redlined prints from your last set of referral comments.) Note: also attached
is one (1) copy of the engineering response letter from Shear Engineering Corporation and the
Revisions Routing Sheet from Current Planning.
This is a response to the most recent review comments concerning the Final Site and Landscape
Plan, Final Utility Plans and Final Plat for the Hearthfire P.U.D., Second Filing. This response
will address some of the comments from the Natural Resources Planner, Poudre Fire Authority,
Transportation Planning, Technical Services Department (Mapping & Drafting), Engineering,
Stormwater Utility, and Current Planning as noted in your letter and the Project Comment Sheets
dated July 21, 2000. Shear Engineering Corporation has written separate letters to Engineering
and Stormwater to address their specific comments as well as the engineering and plat related
comments from the other departments. Copies of those letters are included in this resubmittal.
1. Natural Resources Planning Department
a. Expand the Wetlands Mitigation Map - Contextual Plan to include the property
adjacent to and west of Town Center Way.
- This item has been continually discussed with staff and continues to be a
requirement from Natural Resources. Because of this we met with staff on
site on May 19'h, 2000 to discuss this item and it was agreed that if and when
the property to the south developed, the current owners, The Water Supply
and Storage Company, would be required to provide wetlands and
environmental studies to determine the limits and setback requirements from
the natural features and wetlands at that time. Therefore, because future
development of the parcel is uncertain at this time, we agreed with staff that
additional wetlands delineation studies would not be required until such time
as the property to the south submits for development review. At that time the
