19.The City of Fort Collins shall not be responsible for any damages or injuries
sustained in this Development as a result of groundwater seepage, whether resulting
from groundwater flooding, structural damage or other damage unless such damage
or injuries are sustained as a result of The City of Fort Collins failure to properly
maintain its water, wastewater, and/or storm drainage facilities in the development.
8. All damaged existing curb, gutter, and sidewalk shall be replaced prior to the
acceptance of completed improvements.
9. Prior to the commencement of any construction that will affect traffic signs of any
type, the contractor shall contact The City of Fort Collins Streets Division, who will
temporarily remove or relocate the sign at no cost to the contractor; however, if the
contractor moves the traffic sign himself, the contractor will be charged for the labor,
materials and equipment to reinstall the sign as needed.
10. Maintenance of onsite drainage facilities shall be the responsibility of the property
owners.
11.All recommendations of the final drainage and erosion control study for the (name of
the development) development by (Engineering Firm) will be complied with.
12. The minimum cover over water lines is 4.5 feet and the maximum cover is 5.5 feet.
13. Prior to final inspection and acceptance by The City of Fort Collins, certification of
the drainage facilities, by a registered engineer, must be submitted to and approved
by the Stormwater Utility Department. Certification shall be submitted to the
Stormwater Utility Department at least two weeks prior to the release of a certificate
of occupancy for single family units. For. commercial properties, certification shall be
submitted to the Stormwater Utility Department at least two weeks prior to the
release of additional building permits to those allowed prior to certification per the
Development Agreement.
14. If dewatering is used to install the utilities, a State Construction Dewatering
Wastewater Discharge Permit is required if the discharge is into a storm sewer,
channel, irrigation ditch, or any waters of the United States.
15.All construction activities must comply with the State of Colorado permitting process
for "Stormwater Discharges Associated with Construction Activity." For information,
please contact The Colorado Department of Health, Water Quality Control Division,
WQCD-PE-B2, 4300 Cherry Creek Drive South, Denver, Colorado 80222-1530.
Attention: Permits and Enforcement Section. ph.: (303) 692-3590. Identifying the
need for a permit, preparing the application, and paying for the review and submittal
fees necessary to secure this permit, will be the responsibility of the contractor.
16. Project Benchmark: City of Fort Collins, (Vertical Control).
17. Temporary erosion control during construction shall be provided as shown on the
Erosion Control Plan.
18. The Developer is responsible for all costs for the initial installation of traffic signing
and striping for the Development related to the Development's local street
1. All street, sanitary sewer, storm sewer, and water line construction shall conform to
The City of Fort Collins standards and specifications current at the date of execution
of the Development Agreement pertaining to this development. Any construction
occurring three years after the execution of the Development Agreement shall
require re-examination of the plans by the City Engineer who may require that they
be made to conform to the standards and specifications current at that time. (Note:
If there is no Development Agreement associated with the project, this note
needs to reference the approval of the Utility Plans.)
2. No street work including the placement of curb, gutter, sidewalk, and pavement shall
begin until the soils report and pavement design are approved by the City Engineer
and meet the requirements stated in the "Design and Construction Criteria,
Standards, and Specifications For Streets, Sidewalks, Alleys, and Other Public
Ways" manual.
3. The type, size, location, and number of all known underground utilities are
approximate as shown on the drawings. It shall be the responsibility of the contractor
to verify the existence and location of all underground utilities along the route of the
work.
4. The engineer who has prepared these plans, by execution and/or seal hereof, does
hereby affirm responsibility to The City of Fort Collins, as beneficiary of said
engineer's work, for any errors and omissions contained in these plans, and
approval of these plans by the City Engineer shall not relieve the engineer who has
prepared these plans of all such responsibility. Further, to the extent permitted by
law, the engineer hereby agrees to hold harmless and indemnify the City, and its
officers and employees, from and against all liabilities, claims, and demands which
may arise from any errors and omissions contained in these plans.
5. When an existing asphalt street must be cut, the street must be restored to a
condition equal to or better than its original condition. The existing street condition
shall be documented by The City Construction Inspector before any cuts are made.
Patching shall be done in accordance with The City of Fort Collins Street Repair
Standards. The finished patch shall blend in smoothly into the existing surface. All
large patches shall be paved with an asphalt lay -down machine. In streets where
more than one cut is made, an overlay of the entire street width, including the
patched area, may be required. The determination of need for a complete overlay
shall be made by The City Engineer at the time the cuts are made.
6. Prior to the commencement of any construction, the contractor shall contact all
utilities to coordinate schedules and contact The City Forester to schedule a site
inspection for any tree removal requiring a permit.
7. Prior to the commencement of any construction, the contractor shall give The City of
Fort Collins Engineering Department (221-6605) and The Erosion Control Inspector
(221-6589) twenty-four (24) hours advance notice.

12. Since not providing detail D-19 that indicates the crown transition distance indicate what this distance is on the
street design.
13. Provide the following details: Details for ramps at access drives that do not wrap around the drive. Detached
walk midblock ramp detail. Enhanced crosswalk details.

Plat
1. Provide sight distance easement restrictions. - yes there is a sight distance easement, it is at the corner of Bon
Homme Richard Drive and Nimtz Drive.
2. Provide a place for district signatures. You are vacating one of their easements on the plat and although you
speak of dedication of additional easements to them on the plat there are no easements that are indicated that
they are for the district.
3. Need to show the 15 foot utility, drainage, grading and landscape easement that was dedicated by separate
document adjacent to the streets. If wish to vacate any of the easement or type of the easement it needs to be
shown and indicated.
4. How do you propose to vacate the temporary grading and drainage easement on the site? There are no notes
about this.
5. Need to show the 15 foot utility easement and the 20 foot drainage easement that was dedicated on Tract B of
the first filing. Need to indicate vacation of the drainage easement if that is desired.
6. Provide and show a 9 foot utility easement adjacent to Enterprise Drive.
7. Building envelopes cannot encroach into the easement areas. Have several areas where it appears there is
encroachment, but difficult to tell as the easements adjacent to the streets are not shown.
8. Need to dedicate the areas shown on the plans as emergency access as emergency access easements. The
emergency access easement allows emergency services to have vehicles towed that are parked within it.
Site Plan
1. Eliminate the loading zone areas or show how these areas will be striped for parking. These serve no purpose
unless they are to be parking areas and are marked as such, if they are not they will become problem parking
areas.
2. Can not drain water out the middle of a driveway. This.is not what is shown on the utility plans. See utility
plans and previous comments.
3. Parking stalls in the lot on Tract C need to be eliminated., Per the street standards need to have a minimum of
50 feet from the street flowline to the nearest parking stall.
4. Do not use driveway cuts for the two emergency access driveways/ sidewalks. Emergency vehicles can go over
the vertical curb. We do not want to promote this as a vehicular area.
5. Building envelopes don't appear to match what is proposed on the utility plans and the plat.
6. Recommend increasing the size of the site and landscape plans to a 1=30 scale to make it easier to read.

Utility Plans
I. Update the general notes - see attached for newest version.
2. Provide the radius being proposed for all the curb returns.
3. Most of the utility connections are now being shown as existing. The first filing plans have not been modified
to add these service connections in. This needs to be done. Any connections in these streets that have to be
done after the street is paved will require the overlay of the entire street. Plan for this or get all of the utility
stubs and connections on the first filing plans, approved and in before the streets out there are paved.
4. Indicate the driveway widths if you are not putting this on the detail. It is not indicated anyplace at the moment.
5. Parking stalls in the lot on Tract C need to be eliminated. Per the street standards need to have a minimum of
50 feet from the street flowline to the nearest parking stall.
6. Indicate with notes or hatching that driveways will be constructed with concrete to the Property line.
7. Provide stations and elevations at all pc's in plan view.
8. Show access ramps in plan view.

lines arc not shown for other, similar, layouts in the project. The District would prefer to eliminate

Dear Mr. Olt,
The Fort Collins - Loveland Water District and the South Fort Collins Sanitation District have reviewed
the above mentioned project and submit the following comments.
Easements are required, on the District's standard easement form, for facilities that are not located
in public ROW. Sanitary sewer easements are to be a minimum of 30 feet wide. Landscaping,
sidewalks, driveways, etc. are not to be located within the easement.
All existing facilities that will not be activated or used are to be abandoned at the main in
accordance with District requirements.
The water line sizing does not appear to be adequate for fire flow and maximum day demand
conditions.
Meter vaults and tap sizes arc to be shown.
The standard thrust block typical is to be replaced with the District's most current typical.
Sanitary sewer line SS7 should be located more directly form manhole #28, and perpendicular, to
Enterprise Drive.
District facilities should not be located over other utilities, such as meter vaults over storm drain
lines.
The proposed connection to the existing manhole is to be core drilled.

14. The Site Plan scale should be changed to be the same as the scale of the
Landscape Plan (1" = 401.

15. Some of the drainage easements are overlapping with some of the
building envelopes. This is not allowed.
16. There are existing swales through this site that were dedicated with
Registry Ridge, 1st Filing. They need to be vacated at this time.
17. The City previously asked that the storm sewers be moved away from the
buildings. This has not been done.
18. Who is responsible for the maintenance of the storm sewers? This should
be the developer's responsibility. .
19. The proposed drainage pans could be combined with the sidewalks to
minimize the hard surface on -site.
Natural Resources (Kim Kreimever)
20. Does the grading plan show grading only and not drainage?

21. What surface material is being proposed for the emergency access
drives?
22. Is there any variation in the architecture, materials, or colors of the
buildings to avoid a monotonous project? This question is directed
primarily to the residential portion of the development.
23. Additional comments are on red -lined plans that are being forwarded to
the applicant.
This completes the staff comments at this time. Additional comments could be
forthcoming as they are received from City departments and outside reviewing
agencies.
Under the new development review process and schedule there is a 90 day
plan revision submittal time -frame mandated by the City. The 90 day
turnaround period begins on the date of this comment letter (July 10,
2000) prepared by the project planner in the Current Planning
7. A copy of the comments received from Donald Dustin of the Stormwater
Utility is attached to this comment letter. Additional comments may be
found on red -lined plans and reports that are being forwarded to the
applicant. Please contact Donald, at 416-2053, if you have questions
about his comments.
8. Representatives of the Technical Services (Mapping/Drafting
Department) offered the following comments:
a. In the Tracts, there is a 20' wide easement across the tracts which
are identified as Drainage Easements. Why is an easement on an
easement needed? Also, Building Envelopes 11 & 15 extend into
these easements, which is not permitted.
b. The property boundary and legal description on the subdivision
plat do close.

The following comments and concerns were expressed at the weekly Staff
Review meeting on June 21, 2000:
Engineering (Sheri Wamhoff)
9. What is the purpose of the enhanced drives into the circles north and
south of the Recreational Open Space?
10. The City does not want the emergency access drives to be shown or
constructed as driveway cuts, with curve returns.
11. The first 3 parking spaces on both sides of the driveways into the c-
store/retail area. This is to maintain the required setback for parking
spaces from streets.
12. All of the necessary easements are not shown on the subdivision plat.
There could be some encroachments that are not allowed.
13. The way they are shown, the emergency access lanes could/would be
parked in. This is not allowed. The reality of these needs to be evaluated.
Please include the Poudre Fire Authority in any discussions about this
issue.
2. A copy of the comments received from Terry Farrill of the Fort Collins -
Loveland Water District and the South Fort Collins Sanitation
District is attached to this comment letter. Please contact Terry, at 226-
3104 - ext. 14, if you have any questions about his comments.
3. Kate Browne of the Thompson School District R24 stated that the
applicant should refer to the 2/ 16/00 Thompson School District R2-J
Development Impact Report. Please note that elementary school
attendance would now be at Centennial Elementary, not Cottonwood
Plains. There are no changes to the middle school and high school
attendance locations.
4. Ward Stanford of Traffic Operations stated that the 2 crosswalks on
Enterprise Drive, just north and south of the Recreational Open Space
on the west side of the street, are to be painted, striped crosswalks, not
enhanced.
5. Jenny Nuckols of the Zoning Department offered the following
comments:
a. Handicapped ramps are needed where sidewalks meet the
enhanced crosswalks (marked in yellow on the Site Plan).
b. If the residential trash enclosures are large enough to house 2
dumpsters (for trash and recyclables), then 7 enclosures may be
adequate. Otherwise, please consider adding a couple more
enclosures.
C. Plant Note #4 on Sheet 3 of 8 of the Landscape Plan needs to be
changed to read "value of landscaping and installation".
d. Remove the word "any" in the second paragraph of Note # 14 on the
Site Plan (Sheet 1 of 8). All trash enclosures must be gated.
e. Identify what the elevations are for on Sheet 4 of 8 - Elevations.

Preliminary & Final that were submitted to the City on May 29, 2000, and
would like to offer the following comments:
1. Jim Slagle of Public Service Company (New Century Energies) offered
the following comments:
a. PSC needs 9' of easement space back of right-of-way (ROW) for the
installation of gas lines. Buildings 1, 4, 6, 7, 8, 14, and 15 are too
close to the ROW to allow for the installation of gas lines.
b. Trees must not be planted within 4' of gas lines. This issue was
not addressed from his 2/ 10/2000 comments.
C. The driveway areas between Buildings 1, 2, 3, 4 and Buildings 15,
16, 17, 18 are not wide enough for water, sewer, gas, and other
utilities that want to use this space. This issue was not addressed
from his 2/ 10/2000 comments.
d. In general, gas lines will be in the utility easements adjacent to
both sides of all streets and in the driveway areas between all of
the buildings. This issue was not addressed from his
2/ 10/2000 comments.
e. If the water stops for the buildings are going to be the big 4'
diameter pits, they cannot be located in the 9' area back -of -walk.

Department. Upon receipt, the revisions will be routed to the appropriate City
departments and outside reviewing agencies, with their comments due to the
project planner no later than the third weekly staff review meeting (Wednesday
mornings) following receipt of the revisions. At this staff review meeting the
item will be discussed and it will be determined if the project is ready to go to
the Planning and Zoning Board for a decision. If so, will be scheduled for the
nearest Board hearing date with an opening on the agenda.
Please return all drawings red -lined by City staff with submission of your
revisions. The number of copies of revisions for each document to be
resubmitted is on the attached Revisions Routing Sheet. Please contact me at
