An agreement between the Developer and Water Supply and Storage for the area by Tract C was prepared and signed with the First Filing. A copy of this document is included in this submittal and all grading work in this area was completed with the construction of the First Filing. 27. (1) - March, Liley & Olive is addressing all of the easements issues and copies of most of these documents are included in this Resubmittal. (2) - Item noted. (3) - I believe that the "stuff' on Lot 48 refers to the retaining wall and grading to the west of this lot. The engineering plans have been revised to show the design of this wall and a grading and maintenance easement is being submitted by March, Liley & Olive for Lot 48 and Tract K. (4) - Item noted and once all approvals are granted, we will have the oil company sign all needed plans. (5) - March, Liley & Olive is addressing all of the easements issues and copies of most of these documents are included in this Resubmittal. 2. Natural Resources 1. 1 have contacted Doug Moore and he stated that he has no outstanding issues. 3. Technical Services 22. (b) — Note that this item was resolved with the last submittal as follows: Town Center Way has been changed to Turnstone Lane and this was approved by Current Planning on July 26, 2001. 22. (c) - The North County Road 13 annexation request was submitted to the City by March, Liley & Olive, P.C. on December 12, 2001 for the City's action and approval of the annexation. With the submittal of the annexation request, this relieves the developer from any further obligations related to the annexation of CR 13. Also, all notations on the related to this annexation have been removed from the Site and Landscape Plan. 22. (d) Again, this item was addressed with our last submittal as follows: Lot 1 has a restriction that any home must be a minimum of 150' from any existing oil well. The setbacks shown for this lot conform to this 150' requirement. 3. Engineering 8. Item noted. 24. Item noted and drafts and/or final signed easements have been provided to the City by March, Liley & Olive for all outstanding easements. 24. (1) The ROW dedication for CR 13 has been dedicated to the County by the Developer. Copies were sent to the City by March, Liley & Olive on November 8, 2001 and recorded by the County on December 28, 2001. (Copies are included with this submittal). 24. (5) The engineering plans have been revised to show the design of this wall and a access and maintenance easement is being submitted by March, Liley & Olive for Lot 48. 25. College Ave Fort Collins, Colorado 80522-0580 RE: Hearthfire P.U.D., 2nd Filing, Final, #31-95E Resubmittal - Response Letter Dear Steve: Enclosed please find nine (9) copies of the revised Final Site and Landscape Plan as well as five (5) copies of the revised Final Utility Plans as prepared by Shear Engineering Corporation, one (1) copy of the revised Drainage Report, and seven (7) copies of the revised Final Plat as prepared by Fredrick Land Surveying for the Hearthfire P.U.D., Second Filing, Final. (As well as any redlined prints from your last set of referral comments.) Note: also attached is one (1) copy of the Revisions Routing Sheet from Current Planning. This is a response to the most recent review comments concerning the Final Site and Landscape Plan, Final Utility Plans and Final Plat for the Hearthfire P.U.D., Second Filing. This response will address some of the comments from the Current Planning, Natural Resources, Technical Services, and Engineering, as noted in your letter and the Project Comment Sheets dated October 26, 2001. Also, for your information, Lucia Liley has been working directly with Bill Fischer and Paul Eckman on the preparation of the required offsite drainage easements from the Water Supply and Storage Company (see attached letter from Lucia Liley addressing all of the outstanding easements issues and the annexation of the CR 13 ROW). We understand that these offsite easements must be completed and signed prior to the Planning and Zoning Board hearing as well as the issues regarding the final design of Douglas Road. Current Planning 16. The note regarding this fence has been removed from the Site and Landscape Plan. 18.
