SECOND P & Z BOARD HEARING (CONTINUED FROM 9/19/2002) - 31-95E - CORRESPONDENCE - RESPONSE TO APPLICANTCommL_ -Ay Planning and Environmental _ _rvices Current Planning City of Fort Collins November 5, 2002 William Yunker 1412 Richards Lake Road Fort Collins, CO. 80524 Re: Hearthf ire Planned Unit Development (PUD), a Filing, Final - #31-95E Dear William: On November 4, 2002, the Planning and Zoning Board of the City of Fort Collins approved the Hearthf ire PUD, 2"d Filing, Final - #31-95E pursuant to Section 29-526 of the City Code (the Land Development Guidance System). The Hearthf ire PUD, 2"d Filing, Final was granted final approval for 56 single family residential lots on 39.31 acres. Please be advised that the above referenced property, located within the City of Fort Collins, is currently zoned UE - Urban Estate. The applicant is pursuing the completion of utility plans and a development agreement as required by City Code prior to recording of applicable Hearthf ire PUD, 2"d Filing, Final . plans and documents. No further Planning and Zoning Board or City Council approvals are required. However, there is a provision in the City Code that enables any party in interest to submit an appeal of the Board's decision to the City Clerk's office within 14 calendar days of the date of approval for the development request. If appealed, the development request would be scheduled for a City Council public hearing where Council would have the options to remand the project to the Board for a further decision, uphold the Board's decision, or overturn the Board's decision.
