10. LETA
a. Town Center Drive is already in use unless this is a continuation of existing
street.
- This is a continuation of the existing Town Center Drive.

a. An easement is needed for the Swale for the storm water transition from street
flows from County Road 13 to Richards Lake. This is needed before the item can
go to public hearing.
- We have meet on several occasions with The Water Supply and Storage
Company regarding the required off -site drainage easements and their
attorney is preparing an agreement between the developer and Water Supply
for the required drainage easement. Once both parties sign the easement, it
will be forwarded on to the City for recording.
b. Are there wetlands on Lots 27-32? What impacts are associates with this? There
could be restrictions that would have to be imposed on these lots.
- Sheet 2 of 2 of the Site and Landscape Plan shows a total of .15 acres of
wetland area is within these lots. As part of the wetland mitigation plan for
the entire project, both filings 1 & 2, new wetlands were created within the
first filing to compensate for the wetlands within these lots.

5. Natural Resources
a. She needs to do a check between the previous and current Wetlands Mitigation
Plan.
- Sheet 2 of 2 of the Site and Landscape Plan shows the wetland mitigation for
both filings. it should match the previous plan submitted with the I' Filing.
6. Transportation Planning
a. Why has the proposed bicycle/pedestrian path between Bateleur Court and
County Road 13 been narrowed from 6' to 5'9 It must be a minimum of 6' wide.
- This path has been eliminated with the extension of Bateleur Lane out to CR
13.
7. Planning
a. A permanent street connection from either Bateleur Court or Hearthfire Drive to
County Road 13 should be provided...
- This connection has been made.
b. Red -Lined Site and Landscape Plan
- The existing 20' crushed limestone trail has been redrawn to the correct size
of 20'.
- The drive cut at this 20 trail at CR 13 has been changed to a ped ramp.
- On May 8`", Brain Shear and myself met with Ron Gonzales of the Poudre
Fire Authority to discuss an emergency access point at the end of this cul-de-
sac. Ron stated that the emergency access would be acceptable as long as the
roadway was made of road base and that a 2" cover of crushed limestone (so
it would match the pedestrian trails) was installed over the road base. This
note has been revised on the Site and Landscape Plan.
- Plant Note #4 has been revised to include re -green Western Wheatgrass and
eliminated Smooth Brome and Crested Wheatgrass.
- The 5' path to CR 13 has been eliminated with the extension of Bateleur
Lane out to CR 13.
8. Traffic Operations
a. County Road 13 needs to be improved with this development and a permanent
vehicle connection should be made from the county road into the development.
- County Road 13 will be improved as part of the development as show on the
Final Utility Plans as prepared by Shear Engineering Corp. Also, as stated
above, Bateleur Lane has been extended to CR 13 to provide a permanent
vehicle connection.

letter is included in this resubmittal.
c. Hearthfire Drive is longer than 660' and, therefore, a secondary point of access
(emergency or ermanent) must be provided for this cul-de-sac.
- On May 8 , Brian Shear and myself met with Ron Gonzales of the Poudre
Fire Authority to discuss an emergency access point at the end of this cul-de-
sac. Ron stated that the emergency access would be acceptable as long as the
roadway was made of road base and that a 2" cover of crushed limestone (so
it would match the pedestrian trails) was installed over the road base.
d. There is concern about Town Center Way. This area is not very developable
because there are wetlands here. It could/should be more of a "driveway" than a
street. The Water Supply & Storage Ditch Company should be involved in this.
As stated above, after meeting with members of the City staff on site on
May, 19d', it was determined that Town Center Way may or may not be
extended too much further south of the Hearthfire property boundaries in the
future. If and when the property to the south develops, the current owners,
The Water Supply and Storage Company will need to prepare development
and utility plans to show how this area could be developed. Therefore, as
discussed in the meeting and agreed to by Water Supply, the developer
would like to dedicate the required ROW to the City for Town Center Way
at this time and install and stub out any required utilities to the south
property line as development of this 2"d filing occurs. When the development
agreement is prepared by the City, we would request the actual construction
of the walks, curb, gutter and paving not be required at this time, but that a
escrow be established for future construction of the road if development
occurs in the future. Also, Water Supply has requested that a note be placed
on the Final Plat for lots 25 and 26 that states "Town Center Way is a
dedicated public street right-of-way and construction of this street may occur
at any time in the future." This note has been added to both the Site &
Landscape Plan as well as the Final Plat. Also, Water Supply has requested
that a fence be install along the right-of-way adjacent to lots 25 and 26. A
note has been added to the Site and Landscape Plan that states: "A two -rail,
white vinyl fence shall be installed along the property lines of Lots 25 and
26 adjacent to Town Center Way at the time these lots are developed."
e. Need to show bollards at both ends of the emergency access drive for Hearthfire
Drive. Indicating chains - This can be dangerous for bikes and peds who may
use this as a connection to CR 13.
- The bollards have been added to both ends and the chains have been
eliminated. Also, the drive cut from CR 13 to the Whiting Petroleum access
easement has been changed to a pedestrian ramp.
f. Red lined Site and Landscape Plan
- The existing 20' crushed limestone trail has been redrawn to the correct size
of 20'.
- The chain at the end of this 20 trail where it meets Buntwing Lane and also
at the emergency access from CR 13 to Hearthfire Drive has been removed.
- The drive cut at this 20 trail at CR 13 has been changed to a ped ramp.

4. Stormwater Utility

f. Street trees indicated in Landscaping - Assurances Note #2 must be covered
under specific and escrowed, bonded, or letter of credit received in each of those
phases. This is already stated and covered in Landscaping - Assurances Note 41.
Note #2 should be deleted...
- Note # 2 has been deleted.
2. Natural Resources Planning Department
a. Due to the invasive nature of Smooth Brome, the City Natural Resources
Department is encouraging the use of re -green, which is a sterile annual grass.
Please change Plant note #4 on the Site & Landscape Plan to include re -green
and Western Wheatgrass - eliminating Smooth Brome and Crested Wheatgrass.
- This note has been revised.
b. Show any existing wetlands on utility plan sheet 18 where the extension of Town
Center Way is proposed.
- After meeting with members of the City staff on site on May, 19t', it was
determined that Town Center Way may or may not be extended too much
further south of the Hearthfire property boundaries in the future. If and when
the property to the south develops, the current owners, The Water Supply
and Storage Company will be required to provide wetlands and
environmental studies to determine the limits and setback requirements from
and natural features and wetlands. Therefore, because future development of
the parcel is uncertain at this time, we would request that additional wetlands
delineation studies not be required until such time as the property to the
south submits for development review at which time the owners of that
property will be required to provide the required information.
3. Engineering Department
a. The applicant has not yet provided the necessary off -site easements and street
right-of-way documentation.
- We have meet on several occasions with The Water Supply and Storage
Company regarding the required off -site drainage easements and their
attorney is preparing an agreement between the developer and Water Supply
for the required drainage easement. Once both parties sign the easement, it
will be forwarded on to the City for recording.
- Additional street right-of-way dedication is required north of the property on
the east side of County Road 13, (three feet in width from the property north
to the Douglas Road ROW). After discussions with Sheri Wamhoff, it was
determined that this additional ROW should be dedicated to the County
because this portion of County Road 13 will remain in the County. Janelle
Kechter of March and Liley has been working with the Larimer County
Engineering Department to prepare the required dedication documents. Once
these are completed and signed by the owners, copies will be forward on to
the City staff.
b. Hearthfire Drive should be connected as a permanent street to County Road
13...
- We discussed this item in a meeting with City staff on May 1 I1h at it was
determined that Bateleur Court (now renamed to Bateleur Lane) would be
extended to CR 13 to make the requested connection.
- Also, as discussed with Sheri, do to the layout of Bateleur Lane and the close
proximity to the 90 degree turn in CR 13, we could not meet the required
minimum tangent length of 100' at the intersection of CR 13 or the minimum
centerline radius of 240' for the curve to the east of CR 13 and therefore are

Enclosed please find ten (10) copies of the revised Site and Landscape Plan as well as seven (7)
copies of the revised Final Utility Plans as prepared by Shear Engineering Corporation, one (1)
copies of the revised Drainage Report, and seven (7) copies of the revised Final Plat as prepared
by Fredrick Land Surveying, for the Hearthfire P.U.D., Second Filing, Final. (As well as the
redlined prints from your last set of referral comments.) Note: also attached is one (1) copy of the
engineering response letter from Shear Engineering Corporation.
This is a response to the most recent review comments concerning the Final Site and Landscape
Plan, Final Utility Plans and Final Plat for the Hearthfire P.U.D., Second Filing. This response
will address some of the comments from the Zoning Department, Natural Resources Planning
Department, Engineering, Stormwater Utility, Transportation Planning, Current Planning, Traffic
Operations, Poudre Fire Authority, and LETA and noted in your letter and the Project Comment
Sheets dated March 21, 2000. Shear Engineering Corporation has written separate letters to
Engineering and Stormwater to address their specific comments as well as the engineering and
plat related comments from the other departments. Copies of those letters are included in this
resubmittal.
1. Zoning Department
a. Remove the topography lines from this Final Site & Landscape Plan.
- Although we have had many comments regarding both the adding and
deleting of the existing and proposed topo from this plan and that the LDGS
code required the topo on the Site Plan, we have removed it from the
drawing.
b. Why are there veryfew trees proposed for any of the open space tracts? ...
- Additional trees have been added.
c. It would be helpful if the phase lines were made darker...
- The phase lines have been made darker.
d. The project is too small to have 7 phases. No more than 3 will be allowed.
- The phases have been reduced to three.
e. Landscaping - Assurances Note #1 needs to state "valuation of the landscape
installation and material... " NOT just landscape material.
- This note has been revised.
