MARCH 1908-1981 Our firm represents Dalco Land, LLC, the owner of Registry Ridge 3 d Filing ("Registry Ridge"). This letter is in response to your earlier letter scheduling Registry Ridge for Planning and Zoning Board consideration in May due to its apparent inactivity in the City planning process. On behalf of the owner of this project, I am requesting that this matter not be placed on the May Planning and Zoning Board agenda. Although the project consultants have not filed revised plans since the last set of City comments were sent last fall, it is not because the plan is inactive, but rather due to a significant amount of time and effort required to analyze and solve a very difficult sanitary sewer issue, without which plans cannot be revised and submitted to the City. Northern Engineering has been diligently working with the South Fort Collins Sanitation District ("District") to finalize the design and obtain off -site easements for a sanitary sewer outfall. The design for this outfall, including all necessary engineering and surveying, has now been completed in a manner which the developer believes will be satisfactory to the District. However, the District will not review the final design until the two required off -site easements are executed. One of these has been fully executed and the other, which has been verbally agreed upon, has been signed by the developer and sent to the attorney for the off -site owner. In the past months while awaiting resolution of the sewer issue, Northern Engineering has been in discussions with City engineering and stormwater staff about various City aspects of this project. In the opinion of Northern Engineering, the City issues in connection with this project have generally been resolved and City red -line comments have been addressed. It just did not make sense to file final plan revisions without the sanitary sewer design being approved by the District. The Developer believes that the final submission to the District will occur in the very near future. I have reviewed your response with other development review staff and determined that there has been sufficient activity related to this project to avoid taking this project to the Planning and Zoning Board. This project will be permitted to continue processing under the Land Development Guidance System until an additional reassessment is done later this year.
