16. All electric facilities to serve the oil wells will be located within the Whiting
Petroleum Utility Easements as shown on the Final Site and Landscape Plan
and will be dedicated on the final plat.
17. The wetlands impacts from Hearthfire Way have been discussed with the
Natural Resources Department and a permit application has been submitted
to the Army Corps of Engineers and is currently being reviewed.
18. The collector road into Richard's Lake P.U.D. (Morningstar Way) has been
revised to a 76' R.O.W. with parking allowed on both sides.
19. A note has been added to the plan which states: "Lots 22 and 72 shall not be
permitted direct access to the traffic circle."
20. The drop-off zone adjacent to the community building will remain, but no
parking will be allowed on the traffic circle. (Notes have been added to
Site Plan.)
21. There are no raised crosswalks proposed in the development.
22. The plans have been revised to show "knuckles" at 90° curves.
23. The transition on Hearthfire Drive has been revised from a collector to a
local street south of Morningstar Way.
24. A construction phasing plan will be prepared by Shear Engineering and
will be submitted directly to you by Shear. A landscape and community
facilities phasing plan has been incorporated into the Final Site and
Landscape Plan.
Kerrie, I've enclosed copies of the traffic study, soils report, November 25' letter from Shear,
the Matt Delich letter, Final Site and Landscape Plan and the approved street lighting plan
as you requested. The revised plat, utility plans and drainage report will be submitted to you
directly from Shear Engineering.

Dear Kerrie:
As per your project comments of December 22, 1996, and conversations with Brian Shear
and meetings with Brian and Jim Sell, please note the following revisions have been made
to the plans:
1. An extra copy of the traffic study is enclosed for your review.
2. The revised soils report is enclosed.
3. Because of the proximity of the wetlands and the impacts that a subdrain
system could have on these wetlands, no subdrain is proposed. Individual
homebuilders should follow the geotechnical recommendations for perimeter
drains around foundations with sump pits at the.time of home construction.
(This addressed in Terracon's Soils Report.)
4. Off site improvements for Douglas Road are being prepared by Shear
Engineering Corporation and will be submitted directly to you. The developer
has requested the Douglas Road improvements be constructed as part of Phase
but not until 90 building permits are requested. (See letter of November 25,
1996, from Shear Engineering; a copy is enclosed.)
5. Discussions are taking place with all affected property owners to secure any
necessary easements or R.O.W.
6. Douglas Road design criteria items are noted and will be reflected on the plans.
7. Improvements to the Hearthfire Way/Douglas Road intersection are addressed
in the attached letter from Matt Delich.
8. Discussions have taken place between Shear Engineering and the County
regarding off -site improvements in the County. Once plans are completed,
they will be submitted to the County for review and approval.
9. A copy of the Final Site and Landscape Plan is included for your review.
10. The Street Lighting Plan was submitted and approved by Mr. Gary Diede
prior to approval of the Preliminary P.U.D. A copy of this plan is attached
for your review.
it. Barn Swallow Circle has been changed to a shared private driveway.
12. Tangent variance locations have been eliminated and street intersections not
meeting the 2% grade have been identified for the utility plans.
(See response letter from Shear Engineering Corporation.)
13. The crosspans on collector streets have been resolved between Shear Engineering
and Stormwater.
14. The Hearthfire Drive R.O.W. has been changed to a 76' R.O.W. - a collector
street with parking on both sides. Hearthfire Way will remain as a 66' R.O.W.
with no parking.
15. A striping plan will be prepared by Shear Engineering Corporation and will be
submitted by Shear directly to you.

Dear Mr. Sheldon:
In response to your letter of December 16, 1996, to Steve Olt, please note
the following:
1. The City's requirement for C.R. 13 is for the developer to.
pave a width of 24'.
2. An erosion control plan was submitted as part of the utility
plans and measures will be in place during construction.
Also, any storm water runoff which is filtered through the
wetlands will be dispersed through the wetlands as discussed
in the Urban Runoff Mitigation Plan which was submitted to the City.
3. A final drainage report has been submitted to the City for review
and approval.
4. A complete pavement design will be completed for all internal streets
per the City's regulations by a licensed engineer at the time the road
grading is completed. A copy will be submitted to the County at that
time if,requested.

Dear Gary:
As per your comments to Mr. Steve Olt regarding the above referenced proj
please note the following items:

1. A 9' utility easement is shown on the utility plans for Hearthfire
Way and will be included in the deeded roadway.
A 15' utility easement is also shown on the utility plans for the
south side of Douglas Road. This will also be included in the
dedication of the roadway. Any require utility easements for C.R. 13
will be shown on the plat when a final P.U.D. is filed for Phase II.
2. The City's Street Standards adopted under Ordinance #97-1996,
shows the 6' minimum fence setback on the residential local street
section. This is the street section which was shown on our plans.
If there is a conflict with Public Service Co.'s gas lines, we will
revise our street sections, but we feel the City and Public Service
should coordinate on revisions to the street sections to prevent
conflicts in the future.
3. The note "No trees may be planted within 4' of any natural gas line"
is on the Site and Landscape Plan.
I've enclosed a revised copy of the Final Site and Landscape Plan for your review.

Dear Matt:
As per your letter of December 13, 1996, to Steve Olt, please note the following:
1. The agreement with Water Supply and Storage Co. has been finalized
and a signed copy is attached.
2. The detailed grading plan has been completed and is enclosed.
3. Additional information on the volumes of Ponds 1 & 2 has been prepared
and addressed in the revised drainage report to be submitted to you by
Shear Engineering Corporation.
4. Subbasins have been delineated.
5. The proposed grading of the island is shown on the grading plan.
6. The two culverts under Douglas Road carry irrigation water through
the site and not off -site drainage.
7. Shear Engineering Corporation is working with ELCO on supplying an
easement to allow for the flushing of the water tank.
8. Additional copies of both the Urban Runoff and Wetland Mitigation
Reports are attached.
9. Items 9 - 15 are currently being addressed and these items will be resolved
prior to the approval of the final utility plans.

Dear Mr. Barnes:
As per your comments to Mr. Steve Olt, please note the following revisions
have been made to the above referenced plans:
1. After discussions between Tim Buchanan, Fred Haberecht of
Jim Sell Design and yourself, a new landscape note dealing
with escrows, phasing and the required timing of street tree
planting has been developed. The new note which replaces the
old #15 note reads as follows: Landscaping - Assurances:
"1) All landscaping proposed for installation, with the exception of the
surface treatment in residential parkways, must be secured with an irrev-
ocable letter of credit, performance bond or escrow account for 125 % of
the valuation of the landscape material prior to the issuance of a final
certificate of occupancy. The escrow for such landscaping may be phased,
including landscaping associated with street trees indicated for planting in
public right of way in the front or the side of a residential lot."
"2) All street trees indicated for planting in the front or side of a residential
lot shall be planted by the builder or developer no sooner than home
occupancy and no later than 9 months after home occupancy."
2. A new setback to the front of a garage has been added to the plan.
This new setback is 20'.
3. Typical signs have been added to the community building elevations.
