Collins, Colorado Douglas Road slope easement dedications Dear Kerrie, We have received signed letters of intent from several property owners along Douglas Road concerning slope easement dedications for the proposed Douglas Road street widening improvements. These letters will be provided to you by Jim Sell's office. The property for which we have not received a letter of intent for, is owned by Kerry and Debra Sheaman. This property is on the north side of Douglas Road and includes the length of Douglas Road from cross-section Station 13+00 to cross-section Station 34+00 noted on the preliminary Douglas Road improvement plans. Apparently these property owners felt like they required discussion with their attorney prior to committing to slope easement dedication. We have therefore revised the plans at this time to allow a second Douglas Road design alternative along the frontage of the Sheaman property in order to delete encroachment onto this property. The design alternative would provide for slightly steeper sideslopes and guardrail on the north side of Douglas Road in the area of the canal, up to Station 14+00, adjacent to the Sheaman property. Guardrail details will be provided on the final construction plans and will meet the requirements and specifications of the Colorado Department of Transportation. We do not feel that guardrail would be necessary for any more frontage along the Sheaman property since encroachment with 2:1 sideslopes occurs only occasionally. Slope stabilization procedures would be utilized according to specific recommendations made by the geotechnical engineer. Please note that the sections which indicate sideslopes greater than 2:1 are only slightly greater than 2:1. In order to maintain a maximum sideslope of 2:1, the section can still be moved to the right and not result in encroachment on the properties to the south. Attached are the two (2) revised cross section sheets which have the cross sections which affect the Sheaman property. These are for your review and comparison with the initial preliminary Douglas Road improvement plan cross sections previously submitted. If you have aW questions or Brian W. We have discussed with the developer the following compensa- tion for these easements: Grass seeding, construction of a new fence and water drainage enhancement. This letter is to be construed as a letter of intent only and not as a binding contract. Our intention to grant the above - referenced easements is expressly conditioned on the execution of binding agreements for such grants of easement. This letter is to be construed as a letter of intent only and not as a binding contract. The Company's intention to grant the above -referenced easement is expressly conditioned on the execution of a binding agreement for such grant of easement.
