APPEAL PROCESS
A decision of the Planning and Zoning Board may be appealed to the City Council in
accordance with the provisions of Section 2-47 of the Code. Appeals of the Board's
decision regarding a preliminary plan is limited to the land use layout, density of a
project and any conditions placed on a preliminary approval. Appeals of the Board's
decision regarding a final plan will not be allowed to challenge the land use, layout or
density unless these issues have been modified at the time of the Board's decision on
the final plan.

[c] The Planning and Zoning Board may approve, disapprove, or
approve with conditions the proposed planned unit development.
Approval of a preliminary plan shall not constitute final approval of
the final plan, rather, it shall be deemed an expression of approval
of the land use, layout and densities submitted on the preliminary,
plan as a guide to the preparation of the final plan. Modifications
may be required by the Board based on subsequent review of
information provided at the time of final plan submittal.
(5) Final Plan
[c] The final plan shall also comply with all other applicable criteria of
the Land Development Guidance System provided, however, that
the Planning and Zoning Board shall rfet impose additional
requirements or conditions pertaining to the general layout and
densities as shown on the preliminary plan only when additional
information supplied with the final plan submittal indicates such a
change is necessary.

SUBJECT: Proposed LDGS Amendments
Ever since I arrived, there has been discussion about clarifying what the Planning and
Zoning Board actually granted when they gave preliminary approval. The debate
always focused on whether layout and density was "vested" in any way or whether the
Board could make changes.
The attached proposals attempt to do two things:
1. Clarify what preliminary and final approval of a PUD mean; and,
2. Articulate what is appropriate to appeal after decisions on preliminary and
final plans are made by the Board.
I am out of the office most of next week so I would appreciate comments back to me on
Monday, April 17, 1995. Please feel free to dissect, criticize, edit or rewrite.
The proposed schedule to get these changes adopted is:
Late April/Early May.................Mailout to the "Development Professionals" list
and possibly hold an open house to discuss the
proposed changes.
May 22......................................Present to the Planning and Zoning Board
June 6 and 20...........................First and second reading at City Council.
Current Planning staff will review these proposed changes at our April 17 staff meeting.
