The multi -family filing will need a variance to Activity H (for base points) as we discussed. I am in the process of preparing that. The commercial uses will make up the other filing and will be processed and reviewed by the Planning and Zoning Board concurrently with the multi -family filing. This letter confirms our understanding that the applicant will be permitted to split the submitted preliminary pUD into two separate filings as indicated above upon payment of two application fees and submission of two site plans. I have spoken with Sherry wamhoff regarding the process to be used for utility plans. She said that as long as this is only a preliminary PUD and we have already submitted utility plans for the whole area, we do not need to split up the utility plans unless the staff comments which come back on the submitted documents indicate some problem which needs to be addressed, in which case it might make sense to split up the plans when responding to the problem. It is envisioned that most problems have already been addressed with the final PUD for the first filing. Otherwise, the utility plans will just need to be split prior to submitting final plan documents for these last two filings.
