Light and Power
1. Service rights fees will apply to the portion of this annexation served by
Poudre Valley REA (This is the North 1/z and the Southeast 1/a of the
annexation.) Existing customers will pay a 25% service rights fee on their
electric bills for 10 years following transfer of service. New customers will
pay 5%.
2. The SW 1/a of the proposed annexation is within the Public Services electric
service territory. No service rights fees will apply to this portion of the
annexation.
3. See attached letter to owners regarding the service rights fee issue.
Advance Planning
1. Annexation and requested LMN zoning are consistent with policies of City
Plan and agreements with Larimer County.
2. The City cannot annex only the east '/z of Summitview Drive. The annexation
must include all of the ROW.

Re: Electric Service to Ryland Annexation, Fort Collins, CO
Dear Mr. Stark:
The City of Fort Collins Utilities has received a copy of the proposed Ryland Annexation from the City's
Planning Department. Poudre Valley Rural Electric Association (PVREA) currently provides electric
service to most of the annexation. The southwest quarter of the annexation is within Public Service
Company's electric service territory. (Refer to the attached map showing the approximate boundaries
between the two utilities.) Following annexation, the City of Fort Collins will assume responsibility for
providing electric service to the entire area. In most cases, the transfer of service territory will take place
within one year of annexation.
To compensate PVREA for the loss of this territory, Colorado State law requires a payment of service
rights fees to PVREA. The fee is equal to 25% of the City's revenue for electric service to all customers
within the annexation at the time the service territory is transferred to Fort Collins Utilities. A 5% service
rights fee is applicable to new customers added within the annexation boundaries after the transfer of the
service territory to the City. All service rights fees terminate ten years after the electric customers and
facilities are transferred to the City.
It's important you know that service rights fees will apply to the northern half and southeast quarter of the
annexation because the fees are collected from annexed customers through the City's electric rates.
However, the City's electric rates are among the lowest in the State. The City's rates will thus help to
mitigate the impact of the service rights fee. This law does not apply to the transfer of the area within
Public Service Company service territory. There will be no service rights fees collected in the southwest
quarter of the annexation.

Again, this item is scheduled for the September 17th hearing of the Planning and
Zoning Board. PMTs and eight (8) copies of the plan are due by Wednesday,
September 2, 1998.

Dear Ric:
Staff has reviewed the submittal for the Ryland Annexation and Zoning, #33-
98 and would like to offer the following comments:
1. The Current Planning Department offers the following comments:
a) The annexation petition needs to be revised so that a page is created
for the legal description of the county ROW and signature by the
County commissioners. Attached is an example of a petition that you
could follow.
b) The proposed annexation is scheduled for the September 17, 1998,
Planning and Zoning Board hearing. Therefore, please submit PMTs
and 8 copies of the annexation plat by Wednesday, September 2,
1998.
c) The revised annexation petition will need to be submitted to our office
prior to September 17, 1998.
2. The Light and Power Utility offers the following comments:
