PMTs and eight (8) copies of the plan are due by Wednesday, February 2, 1999. To that end, you need to provide a new map of the proposed annexation reflecting the addition of the Rail Road, East Vine Drive right of way, and the Summit View right of way into the annexation. d) Within your new petition for annexation you will need to have 3 legal descriptions including an overall annexation description, a description of the railroad right of way, and a description of your client's property, all with land owner signatures. e) Because of the addition of the railroad property into the annexation; we need you to list them as one of the land owners on your revised application form. This also includes a letter from them authorizing Jim Snell Design to act on their behalf in the annexation process. f) When we worked with Burlington Northern on a 1997 annexation, our point of contact person was: Everett J. Thomas; Burlington Northern Santa Fe Railroad Company; 3700 Globeville Road; Denver, CO 80316. Also, Mark Sears (221-6583) from the city engineering department is our staff expert on dealings with the railroads. g) We talked on the telephone that we tentatively are going to shoot for putting this on the Planning and Zoning Board agenda for February 18, 1999. To make this time frame, the revised annexation petition will need to be submitted to our office prior to January 29, 1999. 2. The Light and Power Utility offers the following comments: a) Service rights fees will apply to the portion of this annexation served by Poudre Valley REA (This is the North 'h and the Southeast'/ of the annexation.) Existing customers will pay a 25% service rights fee on their electric bills for 10 years following transfer of service. New customers will pay 5%. b) The SW '/ of the proposed annexation is within the Public Services electric service territory. No service rights fees will apply to this portion of the annexation. c) See attached letter to owners regarding the service rights fee issue. 3. The Advance Planning Department offers the following comments: a) Annexation and requested LMN zoning are consistent with policies of City Plan and agreements with Larimer County. b) The City cannot annex only the east '/z of Summitview Drive. The annexation must include all of the ROW. 4. The Mapping Department offers the following comments: a) North boundary should go to the north line of Vine Drive. This would include the railroad right of way and Vine Drive right of way. b) Show existing addresses. c) Plat should show who prepared it, etc. Commui Planning and Environmental IF Current Planning City of Fort Collins January 8, 1999 Brad Saucerman Jim Snell Design 153 West Mountain Ave Fort Collins, Colorado 80524 Dear Brad: /ices Staff reviewed the original submittal for the Ryland Annexation and Zoning, #33-98 back in August 1998. A letter was sent on August 27, 1998 to the previous applicant/consultant, Ric Hattman which summarized the staff review comments for the original annexation submittal. The purpose of this letter is to pass along those August staff comments and offer some new relevant - comments. 1. The Current Planning Department offers the following comments: a) Because the applicant has changed from Hattman Associates to Jim Snell Design, you will have to fill out a new Application Form. We will also need a letter from the current land authorizing Jim Sell Design to be the "Applicant / Consultant for the annexation. b) You will need to:resubmit a revised Petition for Annexation. The original annexation petition included a sentence that was added to the standard "petition for annexation" form that stated "Special uses of industrial allowed adjacent to Rail Road right of way." This sentence cannot be added to the petition. If you refer to the Land Use Code Article 4.4(D)(5), we interpret the phrase "buffer and transition from rail switching and industrial uses to the south" to mean that "certain uses permitted along East Vine Drive" is only referring to property on the north side of Vine Drive. Attached is a copy of the original petition for your reference. c) We require that the annexation boundaries must be extended to include the Burlington Northern Railroad right of way, the entire adjacent right of way of East Vine Drive, and the entire -adjacent right of way of Summit View Drive. It is city policy to include adjacent to a property into the annexation, and according to Colorado's Constitution 281 North College Avenue • PO.
