Re; East Ridge Annexation
Dear Brad,
During our October 3, 2001 meeting on the East Ridge Annexation, there were several issues
which the Current Planning Division was unable to give you clear direction on revising the
annexation map. After discussing the annexation requirements of the State of Colorado with the
Deputy City Attorney, we feel we can provide the applicant direction on revising the East
Ridge Annexation Map for further review by the City.
A goal of the City is to annex the portion of East Vine Drive adjacent to this parcel. As you
have indicated, the owners of the railroad right-of-way, which separates the property to be
annexed and East Vine Drive, are not willing to annex voluntarily, leaving a break in the
annexation map. The City has asked Larimer County to sign a petition to annex the portion of
East Vine Drive adjacent to the parcel. This will allow the annexation of East Vine Drive and,
with two petitioners, it may be possible to annex the railroad right-of-way. This is unclear at
this time, -since there are evidently two owners of record for the railroad right-of-way. City
staff will further pursue this possibility if Larimer County agrees to sign the annexation
petition. In the event Larimer County agrees to sign a petition, the City will revise the petition
for both the County and the applicant to sign. The revisions to the annexation map would rest
with the applicant. Larimer County has indicated that it may not render a decision to sign the
petition until the end of next week (October 12).
Another possibility would be to annex the East Vine Street Right -of -Way without the consent
of Larimer County or the railroad. Since the railroad right-of-way is held by a transportation
company, it is possible to `jump' this right-of-way without effecting the adjacent property's
contiguity. This may be the most likely scenario. This would require a revision to the
annexation map by the applicant.
