This project consists of 116 single family lots on 28.26 acres located on the southside of West Elizabeth Street, at Rocky Road, east of Overland Trail Park. (See map.) This decision has been appealed and will be considered by Council on May 7, 1996. The appellant claims that the Board failed to properly interpret five of the All Development Criteria of the L.D.G.S. The appellant further claims that the Board considered evidence which was substantially false or grossly misleading. Finally, because of scheduling problems, the appellant claims that the Board ignored its previously established rules of procedure. Council will receive a copy of the video tape of the P & Z hearing as well as the written verbatim transcript. The City Attorney's Office will prepare a memo explaining the legal aspects of the Appeal. The Current Planning Department will prepare a memo explaining the Board's action and their interpretation of the All Development Criteria. A copy of the Staff Report to the Planning and Zoning Board will be included in Council's information packet. The slides shown to the Board will be available at the Council hearing. The following Staff members will be on hand to address specific issues: Eric Bracke, Transportation; Sheri Wamhoff, Engineering; Basil Hamden, Stormwater; Craig Foreman, Parks and Rec; Rob Wilkinson, Natural Resources. Ted Shepard, Project Planner, will provide a brief description of the project at the beginning of the Appeal hearing.
