A notice of this reimbursement obligation will be filed with the Larimer County Clerk. This is not an invoice for payment. Witness my hand and official seal Notary Public My Commission Expires NOTICE OF REIMBURSEMENT OBLIGATION TO ALL PERSONS TAKE NOTICE OF THE FOLLOWING: WHEREAS, Section 24-95 of the Code of the City of Fort Collins further provides that if the City has constructed such local portion of a public street adjacent to underdeveloped 'property or property that may be redeveloped, the City may require, at or before the time of issuance of any building permit for new development or change of use, that the owner of such adjacent property repay to the City its cost in constructing such local portion of such street; with the amount of reimbursement to be paid to. the City to be no less than the original cost of the improvements plus any mutually agreed upon amount to reflect the effects of inflation, if any; with the original cost of the improvements to mean the cost of financing, engineering, construction and any other costs actually incurred by the City which are directly attributable to the improvements; and WHEREAS, the City has improved Harmony Road as part of the Street Oversizing Program which improvements include; re -aligning and upgrading the road to meet new arterial standards which include detached sidewalk, curb and gutter and landscaped medians. Also, there are problems at the Harmony -Shields intersection, but the impacts of Harmony Ridge 2nd Filing are not great enough to cause a level of service (or "APF) hold to be placed on this development. It references an inflation factor which I calculate to be 22.21 % from April of 1999 to October of 2004. He will forward the repay amount to you, for the Harmony Road realignment/improvements. I am not aware of there being an "Adequate Public Facilities" hold on Harmony Ridge 2nd as a result of the Harmony -Shields intersection. I will copy this message to the City Traffic Engineer, Eric Bracke, to respond to that question. Please let me know if you do not get the answers you need. He was very forthright in identifying beyond the builder costs, a fee would be needed for realigning Harmony Road and he had concern about the intersection of Harmony and Shields as it seemed to be "failing" from a safety standpoint. I asked what he needed to determine the costs levied against our development. He said he would need a TIS to his traffic engineer. This I provided even before the PDP application submittal. I wanted to know our estimated costs. The TIS did not identify a volume problem currently or with the addition of our 59 unit
