B. The Harmony Ridge PUD, First Replat, being a replat of Lots 16 and 22 and
Tract 7 of Phase One satisfies the development standards of the LMN zoning
district.
C. The Harmony Ridge PUD, First Replat, being a replat of Lots 16 and 22 and
Tract 7 of Phase One, complies with all applicable General Development
Standards contained in Article 3 of the Land Use Code.
DECISION
The Harmony Ridge PUD, First Replat, being a replat of Lots 16 and 22 and Tract 7 of
Phase One, #8-99E, is hereby conditionally approved by the Hearing Officer contingent
upon the following condition being satisfied:
The Applicant shall:
1). Obtain from the City of Fort Collins Natural Resources Department, a utility
easement, of a size and within a location satisfactory to the City Engineer, for the
maintenance and repair of the proposed 8-inch sanitary sewer main serving the
Development; or
2). Provide an alternative sanitary sewer service design serving the Development, in a
manner satisfactory to the South Fort Collins Sanitation District.
Dated this 5th day of July 2002, per authority granted by Sections
1.4.9(E) and 2.1 of the Land Use Code.

FACTS AND FINDINGS
The surrounding zoning and land uses are as follows:
N: LMN; existing multi -family residential (Harmony Ridge PUD)
S: POL; existing City -owned natural area (Cathy Fromme Prairie)
W: LMN, POL; existing multi -family residential and City -owned Natural Area
(Harmony Ridge PUD, Cathy Fromme Prairie)
E: LMN; existing multi family and single family residential (Harmony
Ridge PUD)
This property was annexed into the City as part of the Harmony -Taft Annexation
in April, 1989.
The subject property (Lots 16 through 22 and Tract 7) was originally subdivided
as part of the Harmony Ridge PUD, Phase One final plan that was approved by
the Planning and Zoning Board on July 16, 1998.
1. Compliance with Article 4 and the LMN Zoning District Standards:
The Project Development Plan complies with all applicable requirements of
Article 4 and the LMN Zoning District. The Staff Report summarizes the PDP's
compliance with these specific standards and no specific evidence was
presented to contradict the statements and conclusion of the staff report
concerning compliance with Article 4 or the LMN District Standards.
2. Compliance with Article 3 of the Land Use Code — General
Development Standards
The Project Development Plan complies with all applicable requirements of
Article 3 including the plat standards of Section 3.3.1. No evidence was
presented to contradict the statements and conclusion of the staff report
concerning compliance or to otherwise refute the compliance with Article 3.
SUMMARY OF CONCLUSIONS
A. The Harmony Ridge PUD, First Replat, being a replat of Lots 16 and 22 and
Tract 7 of Phase One, is subject to administrative review and the requirements of
the Land Use Code (LUC).

NOTICE OF PUBLIC HEARING: Evidence presented to the Hearing Officer established
no controversy or facts to refute that the hearing was properly posted, legal notices
mailed and notice published.
PUBLIC HEARING
The Hearing Officer, presiding pursuant to the Fort Collins Land Use Code, opened the
hearing at approximately 4:30 p.m. on June 26, 2002 in Conference Rooms C and D at
281 North College Avenue, Fort Collins, Colorado.
HEARING TESTIMONY, WRITTEN COMMENTS AND OTHER EVIDENCE:
The Hearing Officer accepted during the hearing the following evidence: (1) Planning
Department Staff Report; (2) application, plans, maps and other supporting documents
submitted by the applicant and the applicant's representatives to the City of Fort Collins;
(3) a sign up sheet of persons attending the hearing; and (4) a tape recording of the
hearing. No members of the general public were in attendance; therefore, no public
testimony was provided. The LUC, the City's Comprehensive Plan (City Plan), and the
formally promulgated policies of the City are all considered part of the evidence
considered by the Hearing Officer.

This is a request to replat Lots 16 through 22 and Tract 7 of Harmony Ridge PUD,
Phase One for the purpose of creating individual lots for each of the 36 multi -family
townhomes on this portion of the development. The property is on the south side of
West Harmony Road, east of South Taft Hill Road, north of the Cathy Fromme Prairie
Natural Area.
