C. The subdivision plat is in compliance with Section 3.3.1(C) Public Sites, Reservations and Dedications in that: 1) An applicant shall be required to dedicate rights -of way (ROW) for public streets, drainage easements and utility easements as needed to serve the area being platted. The ROW for Dusty Sage Loop and Dusty Sage Drive were previously dedicated with the Harmony Ridge PUD, Phase One subdivision plat and the drainage and utility easements necessary to serve these lots will be dedicated with the Harmony Ridge PUD, First Replat subdivision plat, if approved and filed. 2) Reservation of sites for flood control, open space and other municipal uses shall be made in accordance with the requirements of this Land Use Code, and generally, the City Code. 5. Findings of Fact/Conclusion: A. The Harmony Ridge PUD, First Replat contains permitted uses in the LMN — Low Density Mixed -use Neighborhood Zoning District. B. The Harmony Ridge PUD, First Replat meets the procedural requirements located in Division 2.1 - General Procedural Requirements, Division 2.2 - Common Development Review Procedures for Development Applications, and Section 2.4 - Project Development Plan located in Article 2 - Administration. C. The Harmony Ridge PUD, First Replat meets the plat requirements located in Section 3.3.1 - Plat Standards located in Article 3 - General Development Standards. 4 Harmony Ridge PUD, First Replat, being a replat of Lots 16 through 22 and Tract 7 of Phase One - #49-95E June 26, 2002 Administrative Hearing Page 3 3. Article 2 - Administration: The Harmony Ridge PUD, First Replat complies with the applicable requirements of the LUC, specifically the procedural requirements located in Division 2.1 - General Procedural Requirements, Division 2.2 - Common Development Review Procedures for Development Applications, and Section 2.4 - Project Development Plan located in Article 2 - Administration. 4. Article 3 - General Development Standards: The Harmony Ridge PUD, First Replat complies with the applicable requirements of the LUC, specifically the plat requirements located in Section 3.3.1 - Plat Standards located in Article 3 - General Development Standards. A. The subdivision plat is in compliance with Section 3.3.1(A) General Provisions in that: 1) The subdivision plat will be filed and recorded only after having been approved by the Director of Planning, with such approval evidenced in writing on the plat and signed by the City Clerk. 2) Except with respect to property which is platted as an official subdivision (or part thereof), no building permit or certificate of occupancy shall be issued for construction of any new principal building or no act which changes the use of any building shall be permitted until the subdivision plat is filed and recorded in the City of Fort Collins. B. The subdivision plat is in compliance with Section 3.3.1(6) Lots in that: 1) The lots will range in size from 2,826 square feet to 3,315 square feet. There is no minimum lot size requirement in the LMN District. Each lot has direct vehicular access to a public street (Dusty Sage Loop and/or Dusty Sage Drive). 3 Harmony Ridge PUD, First Replat, being a replat of Lots 16 through 22 and Tract 7 of Phase One - #49-95E June 26, 2002 Administrative Hearing Page 2 COMMENTS: 1. Background: The surrounding zoning and land uses are as follows: N: LMN; existing multi -family residential (Harmony Ridge PUD) S: POL; existing City -owned natural area (Cathy Fromme Prairie) W: LMN, POL; existing multi -family residential and City -owned natural area (Harmony Ridge PUD, Cathy Fromme Prairie) E: LMN; existing multi family and single family residential (Harmony Ridge PUD) This property was annexed into the City as part of the Harmony -Taft Annexation in April, 1989. The subject property (Lots 16 through 22 and Tract 7) was originally subdivided as part of the Harmony Ridge PUD, Phase One final plan that was approved by the Planning and Zoning Board on July 16, 1998. 2. Purpose of the Subdivision: The purpose for the replatting of Lots 16 through 22 and Tract 7 of Harmony Ridge PUD, Phase One is to create individual lots for each of the 36 multi -family townhome dwelling units to be constructed on this portion of the development. By definition in the LUC, the 36 townhomes will be single family attached dwellings if the replat is approved. Also, the replat will not increase or decrease the number of dwelling units on this portion of the development. Lots 16 through 22 on the Harmony Ridge PUD, Phase One development plan contain 36 dwelling units in three 4-plex buildings and four 6-plex buildings. The replat will provide for 36 dwelling units in nine 4-plex buildings. Staff has determined that there is no detriment to the development plan associated with the replatting of the 7 lots. 2 ITEM NO. The property is on the south side of West Harmony Road, east of South Taft Hill Road, north of the Cathy Fromme Prairie Natural Area and is in the LMN — Low Density Mixed Use Neighborhood Zoning District. RECOMMENDATION: Approval EXECUTIVE SUMMARY: This is a request to replat 7 multi -family residential lots and Tract 7 in Harmony Ridge PUD, Phase One.
