The Building Inspections Department stated that the present Home Occupation is exempt from Building Code requirements. However, if the office owner/tenant is different than residential owner/tenant, the building is no longer considered a home occupation. This would constitute a change of use which requires the entire building to be brought into conformance with the current building code. The first floor of the structure (office use) must be handicap accessible, including bathrooms. The residential use and office use must be separated by fire resistive construction. The Water and Wastewater Utility Department stated that Water Conservation Standards for Landscaping and Irrigation will be applicable to any proposed or required changes to the exterior landscaping. The applicant indicated that no changes to the existing services are proposed. Please contact Roger Buffington at 221-6681 with any questions regarding these comments. 5. The property is located in the Spring Creek Drainage Basin. The stormwater development fees for this basin are $2,174 per acre based upon the amount of additional impervious surface area and the amount of on -site detention provided. A drainage report and erosion control plan must be prepared by a Colorado licensed civil engineer and submitted with the development application if the additional impervious surface area exceeds 350 square feet. On -site detention may be required and must outlet into the street. Staff recommends that you consult with a licensed civil engineer regarding drainage issues when designing the parking lot on the west side of the building. The Engineering Department stated that any damaged or non -existing sidewalk and handicap accessible curbs must be repaired or installed. This project must either gain its access from Harvard Street or must share the existing access on Drake with the State Farm Insurance building (this will require the applicant to obtain an easement from State Farm). In place of a formal traffic study by a licensed traffic engineer, the applicant may submit a letter to Transportation Department which discusses the parking needs and projected number of customers generated by the change of use. Any addition to the building requiring a building permit will be assessed a Street Oversi2ing Fee of $10,504 per acre for office uses. Standard Utility, Grading, and Drainage Plans must be prepared by a Colorado licensed civil engineer and submitted at the time of development application. However, changing the use to commercial office space will be subject to commercial rates. The applicant indicated they did not intend to change any of their existing services. Drake Road Fort Collins, CO 80525 LAND USE DATA: Request for a change of use from a home occupation single-family residence to professional office use (first floor) and separate residential unit (second floor). The property is located at the southwest corner of E. Drake Road and Harvard Street. COMMENTS: 1. The property is located in the R-L, Low Density Residential zoning district. Office uses must be submitted as a Planned Unit Development subject to the requirements of the Land Development Guidance System. The property is located within the Residential Neighborhood Sign District. The Planning and Zoning Board will review the location of all proposed flush wall signs. All other aspects of signage for developments within the district will be regulated by the City's Sign Code. You must provide two parking spaces per every three employees. Please contact Gary Lopez at 221-6760 with any questions regarding these comments. 2. The Planning Staff has enclosed a copy of the Land Development Guidance System. All Planned Unit Developments are subject to mandatory compliance with all applicable All Development Criteria (see page 61). These criteria are explained in detail on pages 13-60. In addition, the proposed office use is required to earn 50% of the maximum allowable points on Point Chart E. "Business Service Uses" (see pages 71-73). It appears that this project may only potentially earn points for criterion e, f, g, and h and may not be able to achieve 50% of the maximum allowable points. If the applicant is unable to achieve 50% of the points a variance must be requested by the applicant and approved by the Planning and Zoning Board. Variance requests are subject to Section K, "Variance Procedures" of the LDGS (see page 108). A neighborhood meeting will be required prior to the submittal of this development proposal. The Planning Department will make a geographical notification map upon your request to proceed with the project. The developer is responsible for obtaining the names and addresses of property owners within the mailing area. The developer pays the City 50 cents per name for the mailing.
