31. The visual impact of the proposed retaining walls is of major concern. This
development proposal as submitted does not meet All Development Criterion A-
2.3 - Natural Features in the LDGS.
32. How is the site storm drainage being handled? The plans are not clear regarding
the drainage.
33. The proposed retaining walls encroach into Lots 42, 46, and 47.
34. An adequate wetland mitigation plan still has not been submitted to the City for
review.
Transportation Planning (Kathleen Reavis)
35. How does this development provide a bicycle/pedestrian connection to the Fossil
Creek trail in the Cathy Fromme Prairie Natural Area? The original ODP showed
a future connection. A connection is needed, otherwise an "informal" path will
evolve, causing erosion. This could be a challenge. One possible solution is to
construct a small bridge over the Trilby Lateral irrigation ditch. This should be
coordinated with the City Parks Planning Department pertaining to possible joint
funding. The ditch company must be involved, also.
City Forester (Tim Buchanan)
36. Autumn Purple Ash is not on the City's Street Tree List. Change the Autumn
Purple Ash to another species on the list (attached).
This completes the staff comments at this time. Additional comments will be
forthcoming as they are received from City departments and outside reviewing
agencies.

16. Some portions of lots are within the Trilby Lateral Ditch Company easement.
This cannot occur.
17. There appears to be exclusive easements for the Districts that this development
wants to encroach into, use portions of. This cannot occur.
18. A basements being proposed? The soils report indicates high ground water in
this area.
19. How, does this development tie into Fromme Prairie Way?
20. Show street transitions.
21. Some merging vertical street curves do not match. ,
22. Some portions of the streets are too steep. A variance for street grades is
required.
23. There is some new subdivision plat language that needs to be included.

24. The storm sewer has to be in a drainage easement.
25. For storm drainage from this development to drain into the Trilby Lateral
irrigation ditch approval is needed from the ditch company.
26. The proposed retaining walls are not clearly shown on the utility and grading
plans.
27. Details of the retaining walls are needed. They need to be designed as structural
walls if taller than 3'.
28. Some trees are encroaching onto the storm sewers.
29. The angle of the proposed storm sewer across the Trilby Lateral ditch is not
acceptable.
Natural Resources (Kim Kreimeyer)
30. Natural Resources has concerns about the massing of the proposed buildings.
The views from the City trail in the Cathy Fromme Prairie Natural Area may be
significantly compromised because of the buildings.
10. Kathleen Reavis of the Transportation Planning Department offered the
following comments:
a. Still need to show a trail access from the eastern end of Skunkbush Drive
to the public trail in the Cathy Fromme Prairie Natural Area, or from the
opening between Lots 41 & 42 to the trail.
b. Show the pedestrian connection from the end of Prairie Ridge Court to
Fromme Prairie Way. Also, show the connection at the north end of
Skunkbush Drive.

is attached to this comment letter. Additional comments are on red -lined plans

The following general concerns were discussed at the Staff Review Meeting on April 11,
2001:
Planning
13. Street trees are needed along Fromme Prairie Way.
14. Is the developer open to discussing the sale of the ridgeline lots, maybe to the
City to add to the natural area?
15. City staff continues to have significant concerns about the layout of this project,
the visual impacts of the housing on the ridgeline overlooking the Cathy Fromme
Prairie Natural Area, the disturbance of the natural slopes with the proposed
retaining walls, the visual impacts of the walls on the natural area, and storm
drainage impacts. It appears that the developer is unwilling to move the homes
further from the ridgeline to help mitigate the impacts. Therefore, in an effort to
bring the development proposal to some form of resolution, staff is going to
place this development request on the May 17, 2001 Planning and Zoning
Board agenda as a discussion item. Staff will not be recommending approval
of the request. You, the applicant, and your client will be able to present your
position to the Planning and Zoning Board.
b. Note the building heights on the Building Elevation sheets. This is a
repeat comment.

5. Ward Stanford of Traffic Operations indicated that they have no concerns or
comments regarding this development proposal.
6. A copy of the comments received from Gary Stadele, President of the Trilby
Lateral Ditch Company, is attached to this comment letter. Also, a copy of a
Grant of Easement and Agreement for the Harmony Ridge PUD between the
Trilby Lateral Ditch Company and Free Enterprises, Inc. (the developer for the
Harmony Ridge PUD) is attached. The ditch company is expressing some very
serious concerns about potential impacts of this development on the Trilby

7. Craig Foreman of Parks Planning indicated that they have no concerns or'
, comments regarding this development proposal.
8. Michael Chavez of the Poudre Fire Authority indicated that they have no new
comments for the project at this time. Please refer to comments dated 12/07/00
(attached).
9. The Technical Services Department offered the following comments:
a. The subdivision plat and legal description do not match by several
courses.
b. The subdivision plat title could be:
Harmony Ridge PUD, Second Filing -
A portion of which is a replat of a portion of Tract 7, and a portion of
NW '/< of... etc.
C. The street names need to be checked with Voneen Macklin of the
Current Planning Department to make sure that there are no conflicting
names.

Staff Has reviewed your documentation for revisions to the Harmony Ridge PUD,
Phase II — Preliminary & Final that were submitted to the City on March 21, 2001, and
would like to offer the following comments:.
1. Due to the timing of the initial submittal date for this final PUD request, Harmony
Ridge PUD, Phase II — Preliminary & Final is being reviewed against the Land
Development Guidance System (LDGS), which is in the process of being
replaced by the City's adopted Land Use Code (LUC). This combined preliminary
& final request will go before the Planning and Zoning Board for all decisions.
2. The revised Harmony Ridge PUD, Phase II — Preliminary & Final plan submitted
on 3/21/01 proposes 47 patio homes (small lot single family) and 16 duplex
dwelling units (on 8 lots) on 15.81 acres. This is in conformance with the
approved Minor Amendment to the Harmony Ridge Overall Development Plan
(ODP). The gross residential density would be 3.98 dwelling units per acre (63
du's / 15.81 acres), which also is in conformance with the approved Amended
ODP.
3. A copy of the comments received from Terry Farrill of the Fort Collins -
Loveland Water District and the South Fort Collins Sanitation District is
attached to this letter. Please contact Terry, at 226-3104, ext. 14, if you have
questions about his comments.
4. Jenny Nuckols of the Zoning Department offered the following comments:
a. Because no building elevations for the proposed duplexes have ever been
submitted to the City for review, Minor Amendments will be required for
the duplex elevations prior to the issuance of any permits for the
duplexes.
