Subject: Realignment - Harmony Road
I don't understand the problem. On Harmony Ridge Filing 2, it was over a
year ago you clearly indicated to me that you had allowed JD Padilla to
delay his portion of the realignment fee from Phase 1 until he developed
Phase 2. He is not developing Phase 2. The city will need to collect the
fee for Phase 1 from JD. It is not the intent of Filing 2 developers to pay
any of JD's bills. No agreement or discussion occurred with JD until after
Global Holdings closed on the land sale. Then it was not a discussion. JD
discovered we were not paying his bill and his full intentions were
revealed to somehow force Global to pay his development fee from Phase 1.
No - not interested.
Today, Monday, May 9th, is the 19th day since each department was to return
to Marc Virata the proper language needed for the Development Agreement.
Even Friday, it sounded like your information was eminent. There is a
formula already in place to determine Filing 2 fees for realignment of
Harmony Road. Please complete your responsibility as that is the only fee
or department contribution missing from the agreement.
If you have a question of me or some misunderstanding - please send an
Email or some contact so this fee can be entered properly.
