3. Neighborhood Compatibility
A "Development Proposal Under Review" sign has been posted on the property since November 29,
1995. The sign has remained at the site and has now been there for more than seven weeks. Staff
has not received a single negative response in this time. Further, the applicant has notified the
neighbors on her block of the proposal and has obtained signed approvals from many of them.
The Planning Department has inspected the property. There will be no exterior alterations to the
home, There is ample parking in the two car driveway for parents. The back yard is maturely
landscaped and properly fenced. Staff considers the request to be compatible with the surrounding
neighborhood.
FINDINGS OF FACT/CONCLUSIONS:
A. The request for a Child Care Center for up to a maximum of twelve (12) children in the R-L
Zone satisfies the All Development Criteria of the L.D.G.S.
B. The request exceeds the Zoning Code's minimum requirements for indoor and outdoor play .
areas.
C. Based on citizen input and a site evaluation, Staff considers the request to be compatible with
the surrounding area.
RECOMMENDATION:
Staff recommends approval of Kay Elder Daycare (Stepping Stones Preschool), Preliminary and
Final P.U.D., #52-95.

COMMENTS:
Background:
The surrounding zoning and land uses are as follows:
The property is surrounded by single-family detached homes, all within the R-L, Low Density
Residential Zone District.
The property is Lot 21, Block 15, Parcel Number 9726316021 of the Woodwest, Seventh (7th) Filing
Subdivision. The lot size is 9,057 square feet. The home is 2,232 square feet. The backyard is
fenced in compliance with the Zoning Code for Child Care Centers. The Zoning Code's minimum
requirements for both indoor play area and outdoor play area are satisfied. The property is well
landscaped, well maintained, and contributes to the character of the established neighborhood.
2. Land Use:
A. Residential Density Point Chart
Child Care Centers are included in the definition of Residential Uses according to Point Chart H of
the L.D.G.S. The single-family detached home will remain a dwelling unit for the applicant who,
along with her husband, are the owner -occupants of the home. There is no request for additional
dwelling units. The proposed child care center is a daytime function, not a typical residential
activity. Since the request is not a function of the number of dwelling units per acre, density is not
an issue. Therefore, the calculation afforded by the "Density Chart" of the L.D.G.S. does not reveal
any practical information by which to evaluate the request. Rather, the request has been reviewed
by the All Development Criteria of the L.D.G.S.
B. All Development Criteria
The request has been reviewed by the applicable criteria of the All Development chart of the
L.D.G.S. (See attached). These criteria are satisfied.
C. Zoning Code
The Zoning Code requires that there be a minimum of 2,500 square feet of properly fenced outdoor
play area. The Code also requires a minimum of 40 square feet per child of indoor floor space
reserved for school purposes. These requirements are satisfied, with 3,060 square feet of fenced,
outdoor, play area, and 558 square feet of indoor floor space reserved for school purposes (46.5
square feet per child). ,

PROJECT DESCRIPTION:
This is a request to expand existing day care operations in a single-family home from one which
accommodates six (6) children to one which would accommodate a maximum of twelve (12)
children. (The Zoning Code allows a maximum of six children as a permitted use.) No physical
changes to the property are proposed. There is enough existing play area, both indoor and outdoor,
to facilitate the change in intensity. The property is zoned R-L, Low Density Residential, and is
located at 3136 Longhorn Court within the Woodwest Subdivision.
RECOMMENDATION: Approval.
EXECUTIVE SUMMARY:
Since there would be a maximum of 12 children, the request must be processed as a P.U.D. The
project satisfies the All Development Criteria of the L.D.G.S. The facility exceeds the Zoning
Code's minimum requirements for both indoor and outdoor spaces. The daycare will be in the
ground level of the house. The two car driveway will provide ample space for parents dropping off
and picking up their children. The back yard/outdoor play area is adequately fenced and, overall,
the property is well landscaped, well maintained, and contributes to the character of the
neighborhood.
