Box 580 Fort Collins, CO 80522 RE: Harmony Ridge P.U.D., May 20, 1996 Meeting Dear Mr. Ludwig: The Trilby Lateral Ditch Co. does not want the ditch cut, and ponds placed next to our ditch. The problem is access, and the ease it would be to fill them out of our ditch, which is not allowed. The proposed pond area is in a natural drainage area that flows into Fossil Creek. Lined ponds do not add anything to this drainage, and would cause problems related to the way the ditch feeds the wet lands. We also do not allow any foreign water to be carried in our ditch. This was voted on and passed many years ago. We will not allow any foreign water in our ditch to fill these ponds. This was explained to the Harmony Ridge P.U.D. developers, along with easements, right of way, and other important considerations October 23, 1995 at a meeting with them and our Trilby Lateral Ditch Company shareholders. The City of Fort Collins Planning staff was notified November 20, 1995 that Jim Martell our attorney will handle the Trilby Lateral Ditch Company affairs.
