Subject: Harmony Ridge Status
Good morning.

Joe Vansant, the developer of Harmony Ridge, has raised several concerns that
I said I'd pass along. As you already know, he has been unable to secure the
ROW necessary for the access into Harmony Ridge. The property owners to the
North (Overlook) are refusing to sign the deed of dedication without some
'guarantees' from the City. As I understand them, the guarantees are 1)
unrestricted turning movements at the intersection of 'old' Harmony and Seneca
and 2) access onto 'old' Harmony as shown on the 1/97 approved preliminary
site plan for the Overlook at Arapahoe Farms.
Currently at issue is the fact that the approval for the aforementioned
preliminary is over one year old and therefore may be expired as stated in
Ordinance 161. This matter is currently being reviewed by the City Attorney's
Office and should be resolved today. If the preliminary has expired, I don't
believe that we can give them any guarantees.
Joe Vansant feels that he is being 'held hostage' be the Overlook camp. He
feels the because he has done the engineering work for Seneca, which is
clearly shown on the Master Street Plan, the Overlook camp should not be able
to hold up his project. He has suggested that the City condemn the ROW needed
for Seneca in order for his project to proceed.
This project is on the P&Z agenda for this Thursday (3/19). It seems doubtful
that these issues will be resolved by then, but I told Joe I would do
everything I could to try to make it happen. Joe has also suggested setting
up a meeting with him, the Overlook camp, and City staff. If you think this
would accomplish anything, let me know and I'll try to set up something.
