Yet again, I believe that we are close Win agreement with the Harmony Ridge group. Since my conversation with you this morning, I Have received a 14 page agreement from Harmony Ridge's counsel. I believe that we are within two to three weeks of a final resolution and beseech the city not to jeopardize the talks by allowing final approval before the ultimate Seneca resolution. Clearly, the Harmony Ridge owners, the Overlook owner's ARM the city will benefit from a final solution to the Seneca problem. No doubt,you are hearing the Harmony Ridge side of the Seneca negotiations. If you would like, 1 would "welcome the opportunity to present our side to you. In the mean time, if you have any input, please give me a call. I request that you keep me informed about discussions between the city and Harmony Ridge owners and please do not allow final P.U.D. approval for Harmony Ridge without our input. Thank you. Since that time things have fallen apart, been put back together, and fallen apart again on a number of occasions.. BecauseIour position has never deviated from our 'original agreement with the Harmony Ridge owners, we are very frustrated with what has transpired- I have had a number of discussions with you and other city staff members about•ihis matter , Our last discussion was on May 4th 'at Wheeler's conceptual review meeting' for Poudre Ridge. Af ` that time I was assured that final P.U.D; approval would`not be given io'Harmony Ridge'without a total resolution of the Seneca issue. However, last week I was inf5rmed by Gib Elkins that the, city is proceeding with final approval for Harmony Ridge, allowing a temporary access along Old Harmony in lieu of Seneca Street. Having the city take this position may severely handicap our negotiations.
