LANDS PROPERTY REZON- ING DATE: NOVEMBER 4,1997 I live in Boxelder Estates, which adjoins the subject property referenced above. Over the past five years I have attended neighborhood meetings, sent letters, and spoken at P&Z Board meetings about my concerns regarding development of the subject property. I have been pleased that rity input and that of others has been considered in the planning process. I have just learned that the subject property may be rezoned, which is not of great concerti since the new uses and the old uses are sintilar. What I am concerned about is that the City Council has the option of modifying the P&Z's rec- ornmendation to Council. Specifically, P&Z has attached a condition to their recommendation that requires the P&Z Board to review aird approve of any development that occurs on tire subject property. I understand there is the potential for Council to approve the rezoning without that con- dition and instead require only Planning staff approval of future development. The history of controversy on the subject property is abundant. Issues regarding, ingress/egress, increased traffic on Prospect, conformance to the Prospect Road Streetscape Plan, drainageways, floodways, and connectivity have been of great concern. And not all of these issues have yet been adequately addressed since specifics of the development are not yet known. The P&Z Board has trade good decisions regarding planning on the subject property and I am con- fident that they will continue to do so. On the other hand, planning staff have made impoxtant er- rors applying public policy to the planning process forthe subject property, like allowing the proc- ess to move forward without an ODP. They have also erred in their application of important plan- Aning guidelines. For example, the John's Harley Davidson submittal did not properly consider the the Prospect Streetscape Plan. Only after public input and P&Z scrutiny was the subrnittal revised so that it did comply. I respectfully request that you approve the rezoning with the condition for review/approval as rec- orumended by P&Z. The many unsettled and controversial issues associated with development of this property provide a compelling rationale to give the P&Z Board continued oversight of staff decisions.
