We understand that another Appeal Case, which has yet to be presented before the City Council, is also scheduled for that evening. Given the fact that the Scenic Views Appeal was continued at the City Attorney's insistence, over both Parties objections, because a City Councilman may have errored in making a public statement, it is only fair that this continued case be heard first and concluded prior to hearing a new case that has not been presented before this quasi-judical body. It is also fairer to both Parties of the Scenic View Appeal to have all the facts of this case heard early in the evening when Council Members may be most alert, so no further possible judical errors will occur. It should be noted that the City Attorney's decision to cancel any further voting on the Scenic Views case occurred AFTER all evidence had been presented, and AFTER all public and Council Member discussions had been concluded, and AFTER the Council had voted against the Appelants. Given these facts, it is obvious to an inpartial observer that this case should be concluded FIRST on the evening of May 20, 1997 before any new cases are heard.
