HomeMy WebLinkAboutNEENAN OFFICE BUILDING - RC SITE PLAN REVIEW & MINOR SUBDIVISION - 5-96 - SUBMITTAL DOCUMENTS - ROUND 1 -)-' NOW, THEREFORE, in consideration of the benefit to be obtained by the Applicant through the waiver of its rights to enforce the three (3) week review process by enabling the Applicant to coordinate its preparation of the site and landscape plans and architectural designs with its preparation of utility plans, the Applicant does hereby waive any and all rights that it may have to enforce against the City the provision as contained in Section 29-414(a) of the City Code which requires a decision of the Director of Planning regarding the site and landscape plans are architectural designs within three (3) weeks of submission by.the Applicant. WITNESSETH: WHEREAS, the Applicant has proposed to the City of Fort Collins, Colorado (hereinafter referred to as "City"), a subdivision of certain lands described on Exhibit "A" attached hereto and incorporated herein by this reference, which lands are located in the R-C River Corridor Zoning District in the City, which proposal requires, pursuant to Sections 29-414 and 29-419 of the City Code, an administrative site plan review of the proposed site and landscape plans and architectural designs (building elevations); and WHEREAS, Section 29-414(a) contains a requirement that the administrative site Ian review be conducted, and a decision made by the Director of Planning to approve, deny o di the proposed plan within three (3) weeks of submission by the Applicant, and if not so made, approval shall be deemed to have been given; and WHEREAS, both the Applicant and the City recognize that the proposed project is complex and will require the expenditure of considerable time both on the part of the Applicant and the City in preparing and reviewing the plans required to be submitted pursuant to Section 29-414; and WHEREAS, both the Applicant and the City are concerned that the documents necessary to be prepared and reviewed will be sufficiently complex as to make it impossible to either adequately prepare or review the same within the required three (3) week time period; and WHEREAS, the Applicant is desirous of extending said three (3) week time period in order to better coordinate its preparation of the site and landscape plans and building elevations with its preparation of utility plans (which utility plans are not required to be reviewed under said three (3) week time period); and WHEREAS, the City desires to extend the aforesaid time period in order to afford it an opportunity to better review the coordinated plans; and WHEREAS, the Applicant understands and recognizes that the action of the Planning Director upon the site and landscape plans and architectural designs (building elevations) as required pursuant to Section 29414 does not constitute action by the City in approving any utility plans and that it is the responsibility of the applicant to obtain separate approval of such utility plans prior to the issuance of any building permit for the project.
