In regard to the Harvest Park, PUD, The Writer Corporation ("Writer) agrees to
cooperate with the City of Fort Collins as well as The .lames Company, by granting
temporary construction easements, grading easements and slope easements to r"rade
the McClelland channalA Writer also agrees to cooperate with the City of Fort Collins and
The James Company inigranting easements necessary forthe installation of the sewerand
water line, the widening County Road #9, and the installation of a box culvert across
County. Road 09. Notwithstanding anything stated in this Letter of Intent to the contrary,
Writer's agreements hereunder are subject to Writer's ability to develop Harvest Perk,
PUD, without unreasonable delay or interference.

It is our intention to cooperate with the City of Fort Collins, the South Fort Collins
Sanitation District, and the James Company by granting easements for the purpose of re.
grading rive McClelland channel, constructing a sewer lice through our property and the
conswction m-grading, access for the County Road 9 box culvert It is out
understanding that this letter is a non -binding indication of our intention at this time.
Only a fotmal easement document that may be recorded in the future will legally
encumber the property.
